چکیده
حملات بیولوژیکی، شکل جدیدی از تروریسم بوده که می تواند تأثیرات مستقیم و غیرمستقیم بر ایمنی، رفاه جامعه، زندگی افراد و حتی بر نسل های آینده را در پی داشته باشد. این حملات با بهره گیری از مواد بیولوژیکی مختلف، از طریق ایجاد ترس و وحشت و ایراد آسیب های جسمانی و روانی لطمات جبران ناپذیری را بر آحاد جامعه وارد نموده و تهدیدی جدی برای سلامت عمومی، امنیت اجتماعی و ... به شمار برود، درنتیجه سیاست گذاران و کارشناسان حوزه عدالت کیفری، به منظور اذعان به اهمیت این گونه حملات و آسیب های مادی، معنوی و امنیتی ناشی از آن، نیاز به اقدامات نوآورانه برای مقابله و جرم انگاری بیوتروریسم را در قالب سیاست تقنینی خود تشخیص داده اند، لذا این پژوهش ضمن تعریف، تبیین و تحلیل مفهوم تروریسم بیولوژیک (بیوتروریسم) به بررسی رویکرد نظام سیاست تقنینی ایران درخصوص جرایم بیولوژیکی با هدف شناسایی کاستی ها و چالش های موجود نموده تا از این رهگذر بتواند اقدام به ارائه راه حل هایی برای رفع این شکاف ها و کمبودها نماید.The Legislative Policy of Iran's Legal System against Bioterrorism
Biological attacks are a new form of terrorism that can have direct and indirect effects on the safety, well-being of society, people's lives and even future generations. By using various biological substances, these attacks have caused irreparable damage to the members of the society by creating fear and terror and causing physical and mental injuries and are considered a serious threat to public health, social security, etc. As a result, policymakers and experts in the field of criminal justice, in order to acknowledge the importance of such attacks and the resulting material, spiritual and security damages, have recognized the need for innovative measures to deal with and criminalize bioterrorism in the form of their legislative policy. Therefore, this research, while defining, explaining and analyzing the concept of biological terrorism (bioterrorism), examines the approach of Iran's legislative policy system regarding biological crimes with the aim of identifying the existing shortcomings and challenges in order to provide solutions to solve this problem.
