چکیده
فحشا یکی از معضلاتی است که گسترش آن تأثیرات سوء زیادی بر سلامت اخلاقی جامعه برجای گذاشته و باعث تضعیف بنیان های اخلاقی خانواده و جامعه می شود. همین امر علل بروز فحشا و راهکارهای پیشگیری از آن را به یک ضرورت مبدل ساخته است. براساس ضرورت مورد اشاره، هدف مقاله حاضر بررسی علل بروز جرم فحشا و راه های پیشگیری از آن است. این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانه ای به بررسی موضوع مورد اشاره پرداخته است. یافته ها بر این امر دلالت دارد که فقر و تنگدستی و تقاضای بالقوه دلالان و ناکارآمدی قوانین مهم ترین دلایل بروز جرم فحشا است. توانمندسازی زنان روسپی از طریق نهادها، اصلاح قوانین و تعزیزی دانستن جرم فحشا، مهم ترین راهکارهای پیشگیری از این جرم است. قانون گذار در قانون مجازات اسلامی با تعیین مجازات حدی برای این جرم و ناهنجاری ها راه تسهیل به این جرم را هموار کرده است و هنگام تصویب قانون این موضوع را مد نظر قرار نداده تا برای آن جرم مستقلی در نظر بگیرد. بنابراین تا زمانی که پدیده روسپی گری جزء دسته مجازات های حدی است نمی توان با این پدیده محکم برخورد کرد. بنابراین حکم تعزیری دادن به پدیده فحشا تنها راهکاری است که با تمسک بدان می توان با آن مقابله کرد و آن را تحت کنترل قوانین قرار داد.Causes of the Crime of Prostitution and Ways to Prevent it
Prostitution is one of the problems whose expansion has left many bad effects on the moral health of the society and weakens the moral foundations of the family and society. This has made the causes of prostitution and its prevention solutions a necessity. Based on the mentioned necessity, the purpose of this article is to investigate the causes of the crime of prostitution and ways to prevent it. This article is descriptive and analytical and it has investigated the mentioned subject by using the library method. The findings indicate that poverty and scarcity, the potential demand of dealers and the ineffectiveness of laws are the most important reasons for the occurrence of the crime of prostitution. Empowering prostitutes through institutions, amending laws and criminalizing prostitution are the most important ways to prevent this crime. The legislator in the Islamic Penal Code has paved the way to facilitate this crime by setting a maximum punishment for this crime and anomalies and did not consider this issue when approving the law to consider it as an independent crime. Therefore, as long as the phenomenon of prostitution is not part of the category of extreme punishments, this phenomenon cannot be dealt with firmly. Therefore, punishing the phenomenon of prostitution is the only solution that can be dealt with by adhering to it and bringing it under the control of laws.
