مسئولیت بین المللی کشورها در مبارزه با دوپینگ: تحلیل حقوقی و چالش های اجرایی

چکیده
دوپینگ به عنوان چالشی اساسی در ورزش بین المللی، تعهدات حقوقی دولت ها را در چهارچوب حقوق بین الملل به آزمون می گذارد. این پژوهش با هدف بررسی تعهدات حقوقی کشورها در پیشگیری و مبارزه با دوپینگ، تحلیل مسئولیت بین المللی ناشی از نقض این تعهدات و ارزیابی نقش نهادهای بین المللی مانند آژانس جهانی ضددوپینگ و دیوان داوری ورزش انجام شده است. فرضیه پژوهش این است که نقض تعهدات ضددوپینگ توسط دولت ها می تواند به مسئولیت بین المللی منجر شود، اما چالش های اجرایی مانع تحقق کامل این تعهدات هستند. روش تحقیق پژوهش حاضر توصیفی-تحلیلی است و از منابع کتابخانه ای، اسناد بین المللی و آرای قضایی استفاده شده است. نتایج پژوهش نشان می دهند که کنوانسیون بین المللی مبارزه با دوپینگ و کد جهانی ضددوپینگ چهارچوب حقوقی جامعی ارائه می دهند، اما عدم هماهنگی قوانین ملی، کمبود منابع و فساد در برخی سازمان های ورزشی موانع جدی ایجاد کرده اند. این پژوهش پیشنهاد می کند که تقویت همکاری بین المللی، افزایش نظارت کد جهانی ضددوپینگ و استفاده از فناوری های نوین می تواند به اجرای مؤثرتر تعهدات کمک کند.International Responsibility of States in Combating Doping: Legal Analysis and Implementation Challenges
Doping, as a fundamental challenge in international sports, tests the legal obligations of states within the framework of international law. This study aims to examine states’ legal commitments to preventing and combating doping, analyze the international responsibility arising from the violation of these obligations, and evaluate the role of international institutions such as the World Anti-Doping Agency and the Court of Arbitration for Sport. The research hypothesis posits that breaches of anti-doping obligations by states can lead to international responsibility, yet practical challenges hinder their full implementation. The research method of the present study is descriptive-analytical and library resources, international documents, and judicial decisions were used. The findings indicate that the International Convention Against Doping in Sport and the World Anti-Doping Code provide a comprehensive legal framework. However, inconsistencies in national laws, resource limitations, and corruption within some sports organizations pose significant obstacles. The article suggests that strengthening international cooperation, enhancing WADA’s oversight, and leveraging emerging technologies could facilitate more effective enforcement of these obligations.
