چکیده
دستیابی به قواعد جامع حقوق محیط زیست در زمینه خسارات زیست محیطی و به رسمیّت شناختن قواعد زیست محیطی لازم الرعایه با هدف ارتقای جایگاه محیط زیست و مهم تر از آن جنبه های مؤثّر ارزش گذاری حقوق زیست محیطی بشری، از اهدافی است که در سایه مطالعه اسناد ملی و بین المللی و مشاهده خلأهای تقنینی و اجرایی و استخراج این شکاف ها دنبال شده است. به رسمیّت شناختن از منظر حقوقی با رعایت عناصر شکلی (دسترسی به اطّلاعات زیست محیطی، مشارکت عمومی در تصمیم گیری های زیست محیطی و دسترسی به عدالت) و عناصر ماهوی (هوای پاک، آب و هوای ایمن، غذای تولید شده سالم و پایدار، دسترسی به آب سالم و بهداشتی کافی، محیط های زیستی، شغلی و سرگرمی غیرآلوده، زیستگاه سالم و تنوّع زیستی) از مسیرهای شناسایی حقوق بشر زیست محیطی هستند. تصویب قطعنامه ای که حقّ برخورداری از این حقوق را به رسمیّت بشناسد، رویکرد مثبتی برای تسریع تلاش ها در راستای تضمین بهره مندی از آنها خواهد بود. رویکردی که حقّ محور و تابع آن اقدامات فوری بوده در سایه تعامل کلیه دستگاه های تقنینی، اجرایی و قضایی ممکن استNew national and International Processes of Human Dimensions of Environmental Rights
Acquiring the rules of national and international environmental laws in the field of environmental damage and knowing the necessary environmental rules and interaction of the two with the aim of improving the status of the environment and most importantly, the effective aspects of valuing human environmental rights are some goals that have been pursued in the shadow of studying national and international documents and observing legislative and executive gaps and extracting these gaps. Recognition from a legal point of view by observing procedural elements (access to environmental information, public participation in environmental decision-making and access to justice), and the substantial elements (clean air, safe climate, healthy and sustainable food, access to sufficient safe and hygienic water, non-polluted work and entertainment environments, healthy habitat and biodiversity) is one of the ways to recognize environmental human rights. Passing a resolution that recognizes the right to enjoy these rights will be a positive approach to accelerate efforts to ensure their enjoyment. An approach that is right-oriented and subject to immediate measures that are possible in the shadow of the interaction of all legislative, executive and judicial powers.
