چکیده
شناخت مبانی مالیت به منظور تمیز مال از غیر مال بسیار مهم است. ازآنجاکه در فقه امامیه فقها تعریف یکسانی از آن بیان نداشته اند و در قانون مدنی نیز تعریفی برای مال ارائه نشده، این اهمیت بیش تر نمایان می شود. در پژوهش پیش رو سعی شده است که به ملاک واحدی برای اعتبار مالیت دست یافته، ملاک های بیان شده توسط فقها را تحلیل کرده تا نقاط قوت و ضعف ملاک های بیان شده موردبررسی قرار گیرد. ملاک به دست آمده، این امکان را فراهم می کند که در موارد تردید بین مال بودن یک امر یا مال نبودن آن، مال را از غیر مال تمیز داد. این قدرت تشخیص در موضوعاتِ بسیار مهمی ما را یاری می کند و به دلیل اینکه مالیت، یک امر اعتباری است و شناخت صحیح مالیت و مصادیقش منوط به آگاهی از مفاهیم اعتباری و ویژگی های آن است، از همین رو در این مقاله به چندی از ویژگی های اعتباریات اشاره شده است. نگارنده بر این نظر است که ملاک اصلی و اساسی مالیت، رغبت عقلایی نسبت به آن موضوع است و دیگر ملاک های بیان شده، دارای اشکال بوده و یا زاید می باشند. در پایان دراین باره که در صورت شک در مالیت عرفی و شرعی موضوع چه راه حلی پیش روی ما وجود دارد، بحث و بررسی صورت گرفته است.Fundamentals of Validity of Ownability in Imamiyah Jurisprudence and Positive Laws
Understanding the fundamentals of ownability of a property is important in distinguishing property from non-property. Since jurists of Imamiyah jurisprudence have no consensus on definition of ownability of a property and the Civil Law has not specified what the property is by definition, the importance of understanding the fundamentals of ownability of a property has further come to light. This paper intends to find a unified criterion for validity of ownability of a property, analyze the criteria set by the jurists, and investigate the strengths and weak points of the expressed criteria. The criterion thus achieved helps distinguishing property from non-property in doubtful cases. Such power of distinction helps us in various issues since ownability is a matter of credibility and the right understanding of ownability and its attachments depends upon acquiring knowledge on credit concepts and its specifications. Therefore, this paper points to some instances of credits. The author of this paper is of the opinion that the major criterion for understanding ownability is the rational approach toward this subject and other criteria expressed are either problematic or abundant. The paper has finally discussed available solutions in case doubts appear in conventional and legal ownability of a property.
