چکیده
بزه دیدگی کودک به معنای هر گونه آسیب جسمی یا روانی, سوء استفاده جنسی و یا غفلت و بی توجهی به نیازهای اساسی کودک می باشد. فضای سایبری به عنوان یکی از محیط های نوین ارتباطی, تعاملات خاص خود را می طلبد با وجود همه مزیت ها و جذابیت های این فضا، یکی از مهم ترین مشکلات مربوط به آن بزه دیدگی سریع و وسیع اطفال می باشد که کنجکاوی کودک و عدم قدرت تشخیص او و سرعت و تعدد بزهکاران فضای مجازی، آسیب زا بودن کودکان را در مقابل تهدیدات جنسی در شبکه های اجتماعی، بیشتر می کند. هدف این تحقیق، بررسی مسئولیت های حقوقی درجرم زایی آزارهای جنسی کودکان در شبکه های اجتماعی در حقوق ایران می باشد که با تکیه بر بررسی قوانین موجود و نیز ابهامات و کاستی های حقوقی- اجرایی و نیز تجربه های دیگر کشورها، به روش توصیفی- تحلیلی و مقایسه ای انجام شده است. بررسی وضعیت کیفری و جرم انگاری آزار جنسی کودکان در فضای سایبری در قانون مدون ایران و نیز رویه قضایی و اجرایی با مسایل و مشکلاتی چون؛ ابهام و عدم تمایل به پیگیری کردن ارکان قضایی بدون وجود شاکیان خصوصی دارد. تابو بودن و نیز مسایل و تبعات مطرح کردن آزارهای جنسی در دنیای واقعی و نیز ناشناس بودن و فیلتر بودن و ناتوانی در پیگیری های سایبری در کنار زمان بر بودن چنین پرونده هایی، از عمده مشکلات اصلی حوزه جرایم و آزار و سو استفاده جنسی از کودکان در فضای سایبر در ایران می باشد. گستردگی اصطلاحات مرتبط با آزار جنسی در کشورهای دیگر و وضع قوانین کیفری مرتبط با آن، با در نظر گرفتن روزآمد شدن و گستردگی وسیع آن، نشان از عقب ماندگی جرم زایی کیفری ایران در حوزه جرایم سایبری کودکان می باشد. لذا توجه به ابعاد خرد و خانوادگی، و نیز آگاه رسانی در باب انواع آزاررسانی ها و نیز ابعاد ملی و وضع قوانین به روز و پیاده سازی آن در روال اجرایی و پیوند داشتن با دیگر کشورها، در زمینه پیگیری و صیانت از حقوق کودکان در فضای سایبر، می تواند بُعد بین المللی جرم زایی قوانین کیفری مرتبط با آزار و سواستفاده جنسی از کودکان را پوشش دهد و ضمانت های حداکثری را برای کودکان به همراه داشته باشد.Legal responsibilities in the criminalization of sexual abuse of children in social networks in Iranian criminal law
Child abuse means any physical or mental harm, sexual abuse or neglect of the child's basic needs. Cyberspace as one of the new communication environments requires its own interactions, despite all the advantages and attractions of this space, one of the most important problems related to it is the rapid and widespread victimization of children, which is the child's curiosity and lack of recognition. And the speed and number of criminals in the cyberspace increases the vulnerability of children in front of the physical threats in social networks. The purpose of this research is to examine the legal responsibilities in the criminalization of sexual abuse of children in social networks in the criminal law of Iran, based on the examination of the existing laws, as well as legal-executive ambiguities and shortcomings, as well as the experiences of other countries, in a descriptive way. Analytical and comparative analysis has been done. Examining the criminal status and criminalization of sexual abuse of children in the cyber space in the codified law of Iran as well as the judicial and executive procedure has issues and problems such as ambiguity and unwillingness to follow up judicial bodies without the presence of private plaintiffs. The taboo, as well as the issues and consequences of raising sexual abuse in the real world, as well as being anonymous, filtering, and the inability to follow up on cyber, along with the time-consuming nature of such cases, are among the main problems in the field of crimes and sexual abuse of children. It is in cyber space in Iran. The spread of terms related to sexual abuse in other countries and the establishment of criminal laws related to it, taking into account its modernization and wide spread, shows the backwardness of Iran's criminalization in the field of children's cybercrimes. Therefore, paying attention to the micro and family dimensions, as well as informing about the types of abuses, as well as the national dimensions, and establishing up-to-date laws and implementing them in the executive routine and connecting with other countries, in the field of pursuing and protecting children's rights in the space Cyber can cover the international dimension of criminalization of criminal laws related to sexual abuse of children and bring maximum guarantees for children.
