«تناسب» به مثابه معیاری برای «نظام اداری صحیح» در پرتو نظرات شورای نگهبان (مقاله علمی وزارت علوم)

چکیده
بند 10 اصل 3 قانون اساسی یکی از وظایف دولت جمهوری اسلامی ایران را «ایجاد نظام اداری صحیح و حذف تشکیلات غیر ضرور» برشمرده است. عبارت «نظام اداری صحیح» تصریح شده در این بند مفهومی گسترده است که امکان برداشت های متعدد از آن وجود دارد و با توجه به اینکه تاکنون در نظام حقوقی جمهوری اسلامی ایران تعریف دقیق و مشخصی برای این بند و ضوابط و شاخص های آن ارائه نشده تبیین این مفهوم می تواند اقدامی مؤثر در زمینه ایجاد آن تلقی شود. در این پژوهش به منظور روشن تر شدن ضوابط و شاخص های مفهوم «نظام اداری صحیح» به دنبال پاسخ به این پرسش هستیم که در نظرات شورای نگهبان «تناسب» چه جایگاهی دارد و در صورت پذیرش این موضوع در نظرات شورا این شورا چه نسبتی را میان تناسب و نظام اداری صحیح برقرار کرده است. این پژوهش با بهره گیری از روش توصیفی تحلیلی و با توجه به کاربرد متعدد استناد شورای نگهبان به بند 10 اصل 3 قانون و با استدلال به اصل تناسب اثبات می کند اصل تناسب به عنوان یک شاخص در نظام اداری صحیح مورد توجه شورای نگهبان قرار گرفته است. بنابراین در نظام اداری صحیح در جمهوری اسلامی ایران اصل تناسب با در نظر گرفتن مقتضیات خاص نظام جمهوری اسلامی ایران باید رعایت شود."Proportionality" as a Criterion for a "Correct Administrative System" in Light of the Opinions of the Guardian Council
Article 10 of the third principle of the Constitution of the Islamic Republic of Iran identifies one of the government's duties as "establishing a proper administrative system and eliminating unnecessary organizations." The phrase "proper administrative system" stated in this article has a broad meaning that allows for multiple interpretations. Given that a precise and specific definition for this article and its regulations and criteria has not yet been provided in the legal system of the Islamic Republic of Iran, clarifying this concept can be an effective step toward its establishment. This research aims to clarify the regulations and criteria of the concept of "proper administrative system" by seeking answers to the question of the role of "proportionality" in the opinions of the Guardian Council. If this concept is accepted in the Council's opinions, what relationship does the Council establish between proportionality and the proper administrative system? This research employs a descriptive-analytical method and considers the multiple references made by the Guardian Council to Article 10 of the third principle of the Constitution, arguing that the principle of proportionality has
