چکیده
تلفن هوشمند یکی از فناوری های نوین است که تأثیر زیادی بر شیوه زندگی بشر معاصر گذاشته است. بر این اساس، حقوق و آزادی های بشری که همچنان یکی از مهم ترین مسائل حقوق بین الملل است نیز متأثر از به کارگیری گسترده این وسیله ارتباطی بوده است. ازاین رو بررسی اثرات تلفن هوشمند بر حقوق بشری ضروری است. پرسش این است که اثرگذاری گوشی هوشمند بر حقوق بشری به چه صورت است؛ آیا استفاده از تلفن هوشمند بهره مندی از حقوق و آزادی های بشری را به مخاطره می اندازد یا می تواند فرصت هایی را جهت تسهیل و تسریع برخورداری از این حقوق فراهم آورد. بر اساس یافته های این پژوهش که با روش توصیفی-تحلیلی انجام شده است، تلفن هوشمند ابزاری است که می تواند از یک سو، بهره مندی از برخی حقوق بشری را تسهیل کند و ارتقا دهد و از سوی دیگر، مانعی در راه تمتع از برخی دیگر ایجاد کند و حتی ناقض حقوق بشر باشد. در نتیجه لازم است کشورها بر مبنای تعهدات بین المللی حقوق بشری خود، از فرصت های ایجادشده در این خصوص بهره جویند و همچنین به منظور رویارویی با چالش ها و تهدیدات ناشی از تلفن هوشمند اقدام کنند.Smartphones and their Impact on Human Rights and Freedoms: Threat or Opportunity?
The smartphones are amont modern technologies that have significantly impacted the way of life of contemporary humans. Accordingly, human rights and freedoms, which remain one of the most important issues in international law, have also been influenced by the widespread use of these communication devices. Therefore, examining the effects of smartphones on human rights is essential. The question is how smartphones affect human rights? Do they jeopardize the enjoyment of these rights and freedoms, or can they create opportunities to facilitate and expedite access to them? Based on the findings of this research, which was conducted using a descriptive-analytical method, the smartphone is a tool that can, on one hand, enhance the enjoyment of certain human rights, while on the other hand, it can create barriers to the exercise of other rights. Consequently, it is necessary for states to take advantage of the opportunities created in this regard based on their international human rights commitments, as well as to address the challenges and threats posed by smartphones.
