چکیده
پیشرفت روز افزون فناوری اطلاعات و تکنولوژی سبب شده تا تجار و اشخاص، اعم از حقیقی یا حقوقی از قراردادهای الکترونیکی به عنوان یکی از معتبرترین روش های تجارت استفاده کنند. با این حال، خلأهایی در چهارچوب قانونی حاکم بر قراردادهای الکترونیکی و تجارت الکترونیک در ایران وجود دارد. این خلأها باعث محدودیت در اثربخشی قراردادهای الکترونیکی می شوند. برای کاهش این خلأها، باید به قواعد عام و اصول کلی حاکم بر قراردادها تکیه کرد و ویژگی های اصلی معاملات الکترونیکی را شناسایی نمود. نبود قوانین و مقررات کافی در این زمینه، باعث بروز مشکلات در قراردادهای الکترونیکی شده که می تواند به عنوان یکی از مشکلات اساسی در حوزه حقوق تجارت الکترونیک شناخته شود. پژوهش حاضر با تمرکز بر قرارداد الکترونیک و تعهدات طرفین و ضرورت آن در تجارت الکترونیک، با روش توصیفی-تحلیلی و با استفاده از گردآوری مطالعات کتابخانه ای به بررسی ضرورت های قرارداد در حقوق تجارت الکترونیک ایران می پردازد و در مورد ارائه اقدامات لازم برای اطمینان از مطابقت قراردادهای الکترونیکی با الزامات قانونی آن بحث می کند.Necessities of the Contract in Iran's E-commerce Laws
