درآمدی بر حقوق کیفری توتالیتر در پرتو تحلیل فیلم «زندگی دیگران»

چکیده
حقوق کیفری در صورت استفاده ابزاری از آن توسط حکومت های توتالیتر در جهت سرکوب، قلع و قمع و تامین منافع طبقه حاکم، می تواند موجب بی نظمی و ناامنی شود. رژیم توتالیتر رژیمی است که شامل جنبه های شدید تمامیت خواهی و اقتدارگرایی بوده و با کنترل تمام شئون زندگی افراد، حقوق انسانی و فردی بشر را در جهت منافع رژیم نادیده می گیرد و طبیعناً قوانین و سیاست جنایی این نوع رژیم نیز ضد انسانی و توتالیتر بوده و کرامت انسانی در آن جایگاهی ندارد. مجازات ها در چنین سیستمی ناعادلانه بوده و حاکمان هیچ مسئولیتی ندارند. فیلم مشهور و هنری «زندگی دیگران» محصول سال 2006 آلمان، روایت زندگی یک زوج هنریِ مخالفِ رژیم توتالیتر آلمان شرقی سابق است که توسط پلیس مخفی سیستم (اشتازی) تحت نظر و شنود قرار می گیرند و در این مسیر شاهد نقض اصول بنیادین حقوق کیفری و دادرسی کیفری مانند بازداشت غیرقانونی، شکنجه روانی، نقض حریم خصوصی و نقض دادرسی عادلانه هستیم. بر این اساس، مقاله حاضر با روش تحلیل محتوای کیفی به واکاوی مولفه های حقوق کیفری توتالیتر با تحلیل مولفه ها، پیغام ها و نمادهای این فیلم می پردازد.An Introduction to Totalitarian Criminal Law in the Light of the Analysis of the Movie "The Lives of Others"
Criminal law can cause disorder and insecurity if it is used as a tool by totalitarian governments in order to suppress, destroy and secure the interests of the ruling class. A totalitarian regime is a regime that includes extreme aspects of authoritarianism, and by controlling all aspects of people's lives, it ignores human and individual human rights for the benefit of the regime, and naturally, the laws and criminal policy of this type of regime are anti-human and totalitarian and human dignity has no place in it. The punishments in such a system are unfair and the rulers have no responsibility. The famous and artistic film "The Lives of Others" produced in Germany in 2006 tells the story of the life of an artistic couple opposed to the totalitarian regime of the former East Germany, who are monitored and eavesdropped by the secret police of the system (Stazi), and in this way we witness the violation of the fundamental principles of criminal law and criminal procedure, including illegal detention, psychological torture, violation of privacy and violation of due process. Based on this, this article analyzes the components of totalitarian criminal law by analyzing the components, messages and symbols of this film using the qualitative content analysis method.
