چکیده
امروزه زیست روزانه شهروندان از وقوع گونه ای از نقض مقررات متأثرگردیده که به انگیزه زیستن در شهرها روی می دهند و تداوم و نرخ بالای آن، افزون بر سلب آسایش شهروندان، مستلزم برخورد و مقابله کیفری با آن ها بوده که خود مسئله اجتماعی پیچیده ای را در شهرها به وجود آورده است. این نقض مقررات را، که جرائم و تخلفات شهری می نامند، آینده ای ناپذیرفتنی برای شهرها ترسیم نموده که درخور تداوم نیست. به عنوان راهکار برون رفت، به کارگیری سامانه عدالت کیفری و اعمال برخوردهای سخت و قهری سرلوحه کار قرارگرفته است. پیامدهای حاصله بخش قابل توجی از شهروندان را درگیر رویه های کیفری نموده و هزینه های سنگینی را در بر دارد. این مقاله با بهره مندی از روش توصیفی- تحلیلی و بر پایه منابع کتابخانه ای و تحلیل قوانین نتیجه گرفته است که رویکرد تنظیم گری پاسخگو[1]، برخوردار از سنجه هائی است که می تواند مؤثرتر عمل نماید و بر اساس روش طراحی هرم تنظیم گری پاسخگو، هرم فراخور با این رویکرد را پیشنهاد و تشریح نموده است. This violation of regulations, which are called urban crimes and violations, has drawn an unacceptable future for cities that is not worthy of continuation. As a way out, the use of the criminal justice system and harsh and coercive actions are on the agenda. The resulting consequences involve a significant part of the citizens in criminal procedures and involve heavy costs. Using the descriptive-analytical method and based on library sources and law analysis, this article concludes that the approach of responsive regulation has criteria that can work more effectively, and based on the design method of the pyramid of responsive regulatio، suitable pyramid with this approach Suggests and explains.
