کارکرد اصل مراقبت مقتضی در راستای مقابله با بی کیفرمانیِ سران رژیم اسرائیل در حقوق بین الملل کیفری

چکیده
حملات رژیم اسرائیل علیه مردم فلسطین، همه ویژگی های جنایات بین المللیِ مصرح در اساسنامه دیوان کیفری بین المللی را داراست و لذا جامعه جهانی در مواجهه با وضعیت بغرنج حاکم بر سرزمین های اشغالی، تکالیف مهمی بر عهده دارد. در این میان، دقت در جایگاه و کارکردهای اصل مراقبت مقتضی در حقوق بین الملل کیفری که متضمن تعهد کامل به رعایت هنجارهای بین المللی در مقابله با تجاوزات و جنایاتِ مهم بین المللیِ مقرر در اساسنامه رم و نیز متضمن تکالیف قابل احصا در راستای افزایش سطح همکاری دولت ها با دیوان کیفری بین المللی است، می تواند اثر عملیِ اقدامات در راستای مقابله با بی کیفرمانیِ سران رژیم اسرائیل را ارتقا بخشد.بر مبنای این اصل، در عرصه حقوق بین الملل کیفری، دولت ها باید حداکثر تلاش خود را به منظور همکاری مناسب با یکدیگر و نیز با دیوان کیفری بین المللی به ویژه در زمینه پیش گیری از وقوع جنایات رژیم اسرائیل در سرزمین های اشغالی، محاکمه و مجازات مرتکبان این جنایات، اِعمال همه جانبه معاضدت های قضایی در راستای حمایت از بزه دیدگان انسانیِ جنایات ارتکابی و ترمیم خسارات وارده از حملات صورت گرفته و نیز وضع و اجرای سیستم های تحریمی در عرصه های مختلف نسبت به رژیم اسرائیل، به عمل آورند.به نظر می رسد با نگاه کارکردگرایانه به این اصل، تعهد دولت ها به هم کاری با یکدیگر و نیز هم یاری با دیوان کیفری بین المللی در راستای مقابله با جنایات اسرائیل در سرزمین های فلسطینی، بیش از پیش، عملیاتی می شود. بر این مبنا، بحث از ضرورت همکاری همه جانبه، مسئولانه و دغدغه مندانه دولت ها با دیوان کیفری بین المللی در راستای مقابله با بی کیفرمانیِ سران رژیم اسرائیلی، قابل توجه خواهد بود. در نوشتار حاضر، کوشش شده است در پرتو مطالعه جایگاه و کارکردهای اصل مراقبت مقتضی در حقوق بین الملل کیفری، کارکرد تقیّد بی قید و شرط دولت ها به این اصل در مقابله با جنایات رژیم اسرائیل و مبارزه با بی کیفرمانی سران این رژیم، مورد بررسی قرار گیرد.The Function of the Due Diligence Principle in Addressing the Impunity of Israeli Regime Leaders under International Criminal Law
The Israeli regime's attacks against the Palestinian people constitute international crimes as specified in the Rome Statute. Consequently, the international community bears significant responsibilities in addressing the complex situation in the occupied territories. Central to this endeavor is the precise understanding of the position and functions of the principle of due diligence in international criminal law. This principle mandates full compliance with international norms in addressing aggression and other serious international crimes outlined in the Rome Statute. It also entails quantifiable obligations to enhance governmental cooperation with the International Criminal Court (ICC).The principle of due diligence, as an international legal obligation, can significantly improve the effectiveness of measures aimed at addressing the impunity of Israeli leaders. Governments must exert their utmost efforts to cooperate effectively with one another and with the ICC, particularly in preventing crimes committed by the Israeli regime in the occupied territories, and in prosecuting and punishing the perpetrators of these crimes. Comprehensive judicial assistance actions are essential to support the victims of these crimes, repair the damages caused by the attacks, and establish and implement sanctions systems across various fields against the Israeli regime.Therefore, it is crucial to discuss the necessity for comprehensive, responsible, and concerned cooperation of governments with the ICC to address the impunity of Israeli regime leaders. This article aims to examine the position and functions of the principle of due diligence in international criminal law, emphasizing the importance of governments' unconditional adherence to this principle in confronting the crimes of the Israeli regime and combating the impunity of its leaders.
