مطالعه وظایف و نقش دادستان در مسیر احقاق حقوق عامه در نظام حقوقی ایران و ایالات متحده آمریکا

چکیده
قوه قضاییه به عنوان پشتیبان حقوق فردی و اجتماعی و به جهت پاسداری از حقوق مردم که در صلاحیت قانونی این قوه است، داری تعهداتی است. بخشی از تعهدات قوه قضاییه در این خصوص از طریق دادستان انجام می شود. دادسِتان (مُدَعی العُموم) مقامی قضایی است که افراد را رسماً به ارتکاب جرم متهم می کند و در دادسرا تحت تعقیب قرار می دهد. هدف مقاله حاضر بررسی این سؤال است که دادستان در مسیر احقاق حقوق عامه در نظام حقوقی ایران و ایالات متحده آمریکا چه وظایف و تعهداتی برعهده دارد؟ مقاله حاضر نظری بوده و با بهره گیری از روش توصیفی تحلیلی و به صورت کتابخانه ای به تبیین وظایف و اقدامات دادستان در حفظ و صیانت حقوق عامه و حقوق شهروندی پرداخته است. یافته ها بر این امر دلالت دارد که مطابق قانون اساسی قوه قضاییه و به تبع آن دادستان و سایر مراجع مربوط در این قوه می بایست در راستای انجام وظایف خود به تضمین حقوق عامه و مقابله با عوامل تضییع کننده این حقوق بپردازد. درواقع احساس عدالت و اعتماد به دستگاه قضا به تبع نظارت قضایی بر تأمین و استیفای حقوق شهروندان در مردم فراهم می شود. در حقوق آمریکا نیز دادستان در برابر حقوق عامه و حقوق شهروندی وظایف مهمی دارد که باید این وظایف را منصفانه و بی طرفانه انجام دهد و به دنبال تضمین عدالت و احقاق حقوق افراد باشد.Studying the duties and Role of the Prosecutor in the Path of Public Rights in the Legal System of Iran and the United States of America
As a supporter of individual and social rights, the judiciary has obligations to protect people's rights, which is within the legal jurisdiction of this branch. Part of the judiciary's obligations in this regard are carried out through the prosecutor. The public prosecutor is a judicial official who officially accuses people of committing a crime and prosecutes them in court. The purpose of this article is to examine the question of what duties and obligations does the prosecutor have in the legal system of Iran and the United States of America in the pursuit of public rights? The present article is theoretical and by using the descriptive-analytical method and in a library form, it has explained the tasks and actions of the prosecutor in the preservation of public rights and citizen's rights. The findings indicate that according to the Constitution of the Judiciary, and accordingly, the prosecutor and the related cyber authorities in this branch should guarantee public rights and deal with the factors that violate these rights in line with their duties. In fact, the feeling of justice and trust in the judicial system is provided to the people as a result of the judicial supervision of the provision and fulfillment of the rights of the citizens. In American law, the prosecutor has important duties in front of public law and civil rights, which must perform these duties fairly and impartially and seek to guarantee justice and the rights of individuals.
