چکیده
تبانی در رقابت های ورزشی یکی از مسائل و معضلات ورزش حرفه ای است که سلامت رقابت های ورزشی را تهدید کرده و زمینه ساز جرایم دیگر است. یافتن راهکارهایی جهت پیشگیری از این گونه جرایم و تخلفات یک امر مهم به نظر می رسد. بر همین اساس هدف مقاله حاضر بررسی تبانی در رقابت های ورزشی و راهکارهای مقابله و پیشگیری از آن است. مقاله حاضر نظری است و با استفاده از روش توصیفی تحلیلی به بررسی موضوع مورد اشاره پرداخته است. یافته ها بر این امر دلالت دارد که در سطح بین المللی راهکارهایی برای مقابله با تبانی در رقابت های ورزشی لحاظ شده است. نظام حقوق کیفری ایران نیز برای مقابله با تبانی در ورزش با اقتباس از اساسنامه فیفا و مقررات انضباطی فیفا فقط ضمانت اجرای انضباطی در نظر گرفته است. علاوه بر این، در حقوق داخلی ایران برای تبانی به عنوان یک جرم قواعد ویژه ای در نظر گرفته شده که مجازات هایی ماند جزای نقدی به دنبال دارد. با این وجود، نظام حقوق کیفری ایران، عملاً شاهد نوعی ناکارآمدی، تعارض، نابسامانی در برخورد و موضع گیری نسبت به تبانی در رقایت های ورزشی و کنترل و مهار آن است که چنین وضعیتی، ناشی از مشخص نبودن موضع نظام حقوقی قضایی ایران در رویارویی و عدم وجود یک رویکرد و سیاست جامع و منسجم در این زمینه می باشد.Explanation of Collusion in Sports Competitions and Strategies to Deal with and Prevent it
He called collusion in sports competitions as the biggest threat in the current century, which has led to other crimes in sports spaces. It seems important to find ways to prevent such crimes and violations. In this article, relying on the descriptive-analytical method, an attempt is made to answer the question of what are the dimensions of the prevention strategy against collusion in sports competitions. Therefore, at the beginning, the conceptualization and the adoption of measures to prevent collusion in the context of sports competitions are examined, and the performance of Iran's criminal policy regarding the implementation of each of the mentioned measures is also discussed. In order to deal with collusion in sports, Iran's criminal law system, by adapting the FIFA statutes and FIFA disciplinary regulations, has only considered the guarantee of disciplinary enforcement. While sports crimes in the legal system of countries have a definite, regular and transparent structure, and in the criminal law system of Iran, we are actually witnessing a kind of inefficiency, conflict, disorganization in dealing with and taking a stance towards this phenomenon and controlling and controlling it, which seems Such a lack of success is caused by the lack of clarity of the position of Iran's judicial legal system in the face of the general lack of a comprehensive and coherent approach and policy in this field.
