چکیده
تصویب معاهدات بین المللی در کشور صحنه تقابل میان دو نظام حقوقی متمایز است که در این کشمکش هر نحو قرائت ناهماهنگ از مبانی این نظامات آثار حقوقی متفاوتی را در پی دارد. در واقع دوگانگی حاصل از شرع و قانون اساسی با اصول و قواعد حقوق بین الملل که در عهدنامه های بین المللی متجلی است الزامات قانونی معینی را بر مجری و مقنن تحمیل می کند که شناخت این الزامات به واسطه چگونگی خوانش شورای نگهبان به عنوان دادرس اساسی کشور از اسناد بین المللی حاصل می شود تا سلوک خارجی کشور در عرصه توافق های بین المللی از رهگذر رویه شورای نگهبان در قرائت اسناد بین المللی کامل شود. پرسش اصلی این تحقیق چگونگی الزامات قانونی حاکم بر توافق های بین المللی دو یا چندجانبه از منظر شورای نگهبان است که با روش تحقیق توصیفی تحلیلی و به شیوه گردآوری اطلاعات کتابخانه ای نگاشته شده است. از مجموع نظریات شورای نگهبان، دو ضابطه ماهوی و شکلی در بررسی مصوبات قابل برداشت است که رویه این شورا در بررسی مسائل مستحدثه حقوق بین الملل، که در نهایت به صیانت از حقوق ملت منتهی شده است، را روایت می کند.The Procedure of Monitoring International Treaties in the Legal system of the Islamic Republic of Iran
The ratification of treaties in Iran is the scene of confrontation between two distinct legal systems. In this conflict, any inconsistent interpretation of the foundations of these legal systems results in different legal effects. In fact, the dichotomy between Sharia law and the constitution with the principles of international law, which can be seen in treaties, imposes certain legal requirements on the executive and legislative branches, and the recognition of these requirements depends on the opinions of the guardian council in reviewing international instruments to complete the country's foreign policy in the field of international agreements. The main question of this research is to examine the legal requirements governing bilateral or multilateral agreements, which is written in a descriptive-analytical method. From the total opinions of the guardian council, two substantive and structural rules can be taken in the review of the approvals, which narrate the procedure of this council in examining the emerging issues of international law, which ultimately led to the protection of the people's rights.
