پاسخ های ترمیمی در حمایت از بزه دیدگان جنایت علیه بشریت و جرم نسل کشی

چکیده
عدالت ترمیمی، نوعی عدالت کیفری مبتنی بر «جبران» است. جبران به معنی تلاش برای ترمیم آثار اسف بار جرم و ضرر و زیان های ناشی از آن خواه به صورت کامل و یا به صورت سمبلیک باشد. امروزه موضوع ترمیم و جبران خسارت بزه دیدگان جرایم بین المللی دارای اهمیت است. به دلیل سکوت اساسنامه و متون حقوقی دادگاه های کیفری بین المللی ویژه درخصوص حقوق بزه دیدگان و ترمیم خسارت های وارده به آنها، هم اکنون نوبت به سازماندهی یک رژیم حقوقی- کیفری ویژه برای «ترمیم» خسارات وارد به بزه دیدگان جرایم بین المللی می رسد. درکنار توسل به فرآیندهای ترمیمی در رسیدگی به جنایات بین المللی بالاخص درخصوص کمیسیون های حقیقت یابی و آشتی که منتهی به اعطای عفو به بزهکاران می گردد، روش های ترمیمی دیگری از جمله آموزش به قربانیان و مشارکت آنها در پرونده ها نیز قابل اشاره است. با این همه هنوز عدالت ترمیمی در جنایت علیه بشریت و نسل کشی نوپا بوده اما باید در سطح بین المللی برنامه ای جامع و کامل برای جبران آسیب دیدگی و خسارت قربانیان تدوین و اجرایی کرد.Restorative Responses in Support of Victims of Crimes against Humanity and the Crime of Genocide
Restorative justice is a form of criminal justice based on "compensation." Compensation means trying to repair the deplorable effects of crime and losses, whether in full or symbolic. Today, the issue of repairing and compensation of victims of international crimes is important. Due to the silence of the statutes and legal texts of the Special International Criminal Court on the rights of the victims and the repair of their damages, it is now time to organize a special legal and criminal regime to "repair" the damages inflicted on the victims of international crimes. In addition to resorting to restorative processes in the prosecution of international crimes, especially with regard to the Truth and Reconciliation Commissions which lead to the granting of amnesty to criminals, other restorative methods such as training victims and their participation in cases are also indicated. However, restorative justice in crimes against humanity and genocide is still a new thing, but a comprehensive plan must be developed and implemented internationally to compensate victims.
