بازخوانی وضعیت حقوقی اَیادی غیرِعدوان بر مال غیر (مقاله علمی وزارت علوم)

چکیده
بر پایه نظر مشهور فقها و غالب حقوق دانان، اصل اولی در تصرفات و استیلائات بر مال غیر بر مبنای ضمانی بودن ید استوار گردیده و تمام انواع و اقسام استیلا بر مال غیرْ محکوم به ضمان ید و سبب ترتّب احکام ویژه غصب دانسته شده است. با توجه به تبعیت محض قانون گذار از دیدگاه فقها در وضع مواد ۳۰۱ الی ۳۲7 قانون مدنی و پذیرش نظر مشهور فقها، دیدگاه افراطی مزبور انتقاد جدی شارحان قانون مدنی را به همراه داشته است. اساساً تسرّی مقررات باب غصب درخصوص اَیادی غیرِعدوان که مبنای تصرّف در آن ها بر پایه جهلِ به واقع و اشتباه و فقدان سوءنیت استوار است با اقتضائات عدالت و انصاف و مقتضای اصل برائت در مخالفت آشکار است؛ لذا در این نوشتار تلاش گردیده با استمداد از نظرات پراکنده فقهی و حقوقی و مواد قانونی مربوطه در راستای تعدیل نظر مشهور و تبیین مسئولیت اَیادی غیرِعدوان بر پایه احکام و قواعدِ برگرفته از سایر منابع ضمان قهری نظیر «اتلاف، تسبیب، دارا شدن بلاجهت و ...» برآییم.Re- Reading the Legal Status of Non-Violent Property Owners

And basically, the application of the rules of usurpation to non-aggression, in which the basis of possession and domination is based on ignorance of truth and error and lack of malice, is in clear opposition to the principles and rules of justice and fairness and the requirement of the principle innocence. Therefore, in this article an attempt has been made with the help of scattered jurisprudential and legal opinions and related legal materials in order to modify the popular opinion and explain the responsibility of non-aggressors based on the use of other sources of coercive guarantee take a step.
