چکیده
دسترسی کارکنان سازمانهای دولتی به منابع مالی و وجوه دولتی، که ناشی از رابطه استخدامی و شغلی است، موجب گردیده تا قانونگذار مصرف غیرمجاز اموال و وجوه دولتی را منع و تحت عنوان بزه تصرف غیرقانونی جرم انگاری نماید. سازمان تامین اجتماعی نیز به عنوان موسسه عمومی غیردولتی، که از محل پرداخت حق بیمه، واجد منابع مالی عظیمی میباشد، مشمول این مقرره است. این تحقیق با روش توصیفی-تحلیلی به دنبال بررسی شمول ماده 598 قانون تعزیرات نسبت به شرکت سرمایه گذاری تامین اجتماعی معروف به شستا، میباشد. شخصیت حقوقی شرکتهای تابعه و وابسته بلحاظ انکه تحت کنترل و اداره هلدینگها، شرکت سرمایه گذار و نهایتا سازمان تامین اجتماعی قرار دارند، مبین آنست که شستا در زمره موسسات عمومی غیردولتی بوده و در نتیجه با توجه به اساسنامه سازمان و قانون محاسبات عمومی، هرگونه استفاده غیرمجاز از اموال و وجوه سازمان تامین اجتماعی، خصوصاً از طریق حقوق بیمه ای اشخاص وابسته به سازمان، موجبات مسئولیت کیفری ناشی از تصرف غیرقانونی در اموال و وجوه را فراهم خواهد آوردIllegal seizures of property and funds of public non-governmental organizations in parent companies and subsidiaries of the Social Security Organization
