بررسی تطبیقی قاعده نفی سبیل از دیدگاه فقهای امامیه و اهل سنت

چکیده
موضوع و هدف: در این تحقیق به بررسی تطبیقی قاعده نفی سبیل از دیدگاه علمای شیعه و سنی اختصاص دارد که بررسی دیدگاه سایر فرق مانند حنفی، حنبلی، مالکی و شافعی نیز از دیگر اهداف تحقیق است. یافته های تحقیق: یافتههای پژوهش حاکی از آن است قواعد و اصولی که فقه امامیه و فقه مذاهب اربعه اهل سنت در خصوص موضوع قاعده نفی سبیل، اصل پایبند بودن به قرار دادها و معاهدات، قاعده دعوت، قاعده صمیمیت و برادری در ارتباط با ممالک اسلامی، صلح عزت مدار، قاعده حفظ نظام، دارالاسلام و جهاد و دیدگاهها و نقطه نظرات و کیفیت استدلال همراه با ذکر ادله انها ذکر شد، و برای رسیدن به نظریات فقهاء دو مذهب، ترسیم قواعد و اصولی برای آن بسیار راه گشا میباشد. نتیجه گیری: نتایج تحقیق نشان داد صاحب نظران اهل سنت درباره مفهوم نفی سبیل بیان کردند مقصود از نفی سبیل، نفی حجت و استدلال برای کافران در روز قیامت است. برخی گفتند عبارت است از نفی قدرتی که بتوان دولت و شوکت مؤمنان را نابود کرد. برخی گفتند عبارت است از نفی سلطه دشمنان؛ مشروط به اینکه یکدیگر را توصیه به باطل نکنند و انجام منکرات را ترک گویند و از گناهان توبه کنندو برخی معنای دیگری بیان کردند. در شیعه نیز به نقل ابن عباس و یسع حضرمیاز امام علی علیه السلام روایت شده که: معنای نفی سبیل عبارت است از نفی حجیت در روز قیامت.A comparative study of the rule of negation of mustache from the point of view of Imamiyyah and Sunni jurists
