واکنش شناختی جرایم بورسی در سیاست کیفری ایران

چکیده
حمایت کیفری از بازار سرمایه، موضوعی مستقل، در حقوق مربوط به سرمایه گذاری به شمار می آید. هدف این حمایت، حفظ حقوق سهامداران، ایجاد نظم در بازار داد و ستد سهام و همچنین جلوگیری از رفتارهای زیان بار است. برای رسیدن به این مقاصد، لازم است که ضمانت اجراهای کیفری تعیین شده، با رفتارهای ارتکابی، متناسب باشد و در جهت دستیابی به این مقاصد، تدوین و تصویب شده باشد. مجازات های تعزیری درجه ی 6 و 7 که در اصلاحات سال 1399 نیز به اشکال مختلف مورد تعدیل و تعلیق نیز قرار گرفته است، نمی تواند عاملی بازدارنده و البته اصلاحگر، در مورد رفتارهای زیان آور بورسی به حساب آید؛ از سوی دیگر، به دلیل گستردگی فعالیت های بورسی در سطح جامعه و درگیرشدن گروه های مختلف مردم در این صحنه ی اقتصادی و به دنبال آن، وقوع برخی رفتارهای زیان بار با گستره ی وسیع، موجب شده است که تناسب بین رفتار مجرمانه و مجازات های قانونی تعیین شده، به شکلی آشکار، مورد خدشه قرار گیرد. به نظر می رسد: برای جبران این نقیصه در سیاست کیفری ایران، لازم است که در رفتارهای مجرمانه، بازنگری اساسی انجام شود و از سوی دیگر، با در نظر گرفتن میزان خسارت وارده به اشخاص و کلیت اقتصادی، مجازات های متناسبی وضع شود که قدرت بازدارندگی و خاصیت ترمیمی را داشته باشد.Cognitive Reaction of Exchange Crimes in Iran's Criminal Policy
Criminal protection of the capital market is considered as an independent matter in the rights related to investment. The purpose of this support is to protect the rights of shareholders, to create order in the stock trading market and even to prevent harmful behaviors. In order to achieve these objectives, it is necessary that the determined criminal execution guarantees will be appropriate with the committed behaviors and have been formulated and approved in order to achieve these objectives. The 6th and 7th degree Taeziart punishments, which have been modified and suspended in various ways in the reforms of 2019, cannot be considered as a deterrent factor and, of course, a reformer in the case of harmful stock market behavior. On the other hand, due to the wide spread of stock exchange activities at the community level and the involvement of different groups of people in this economic scene, and the occurrence of some harmful behaviors with a wide range, this has caused that the appropriateness between the criminalized behavior and determined legal punishments, to be violated obviously. It seems that in order to compensate this shortcoming in Iran's criminal policy, it is necessary to fundamentally review the criminal behavior and on the other hand, taking into account the amount of damage caused to individuals and the economy as a whole, appropriate punishments should be established that have deterrent power and restorative properties.
