چکیده
رویه اساسی که مبتنی بر برتری قانون اساسی بر سایر قوانین و لزوم حفظ آزادی اساسی شهروندان در برابر مداخلات دولت است، بر اساس تفویض امور به نهادهای سیاسی، قضایی، اداری و حتی قضایی در حقوق مختلف است. نهادها نهادها سیستم های این تحقیق که با رویکرد توصیفی- تحلیلی انجام شده است، سوال اصلی تحقیق این است که نظام حقوقی پایه در ایران، آمریکا و آلمان چه تفاوتها و شباهت هایی دارد؟ علاوه بر شباهت هایی مانند قاعده منع بکارگیری اعضای نهادهای اساسی قضایی در سایر حوزه ها از جمله ساختار و تشکیلات این موسسات، ابطال تصمیمات آنها، لزوم انتشار آنها در روزنامه رسمی، تفاوت های مهمی نیز وجود دارد. نتایج تحقیق حاضر به شرح زیر است: سایر اختیارات اجرای قوانین با قانون اساسی به شورای معتمد تفویض شود، ثانیاً مدت عضویت اعضای شورا مانند دادگاه قانون اساسی آلمان برای یک دوره است و نمی تواند.. تمدید شود ثالثاً، تصمیمات و نظرات شورای نگهبان فقط در این مورد ماهوی است و مانند دادگاه قانون اساسی آمریکا در زمینه صدور پرونده، شکلی مانند دستور موقت نیست. موارد فوق در این مقاله مبانی سه رویه اساسی و آسیب شناسی شورای نگهبان در ایران مورد بحث و بررسی قرار گرفت و راهکار ارائه شده است.A comparative study of the judicial structure of Iranian, American and German courts
