حقوق اسیران جنگی در رویکرد پیامبر اکرم(ص)؛ از نظر تا عمل با تاکید بر موازین حقوق بشردوستانه در اسلام (مقاله علمی وزارت علوم)

چکیده
دین اسلام به عنوان دین صلح و مودت نه تنها نسبت به موضوعات مرتبط با جنگ، اهداف، مبانی و اصول آن سکوت نکرده است، بلکه با یک سبقه تاریخی چهارده قرنی که از عملکرد پیامبر اکرم(ص) و ائمه معصومین(ع) می توان بدان دست یافت و با توجه به مقتضیات زمانی و مکانی خاص آن دوران توانسته است در این عرصه پیشرو بوده و در پرتو الزام به ضمانت اجرای موثر جهت تضمین حقوق اسیران جنگی در مقام عمل(نه صرفاً تئوری و نظر) گام بردارد.در تاریخ اسلام رویدادهای بسیاری وجود دارد که مبین نحوه رفتار انسان دوستانه پیامبر اکرم(ص) در مقابل رزمندگان دشمن است که به اسارت درآمده اند.سوال اصلی تحقیق حاضر این است که در جنگهای دوران پیامبر اکرم(ص) حقوق اسیران جنگی واجد چه وضعیتی بوده است؟در پاسخ می توان چنین نگاشت که آموزه های دینی اسلام در زمینه رعایت حقوق اسیران جنگی در تئوری و رویکرد پیامبر اکرم(ص) به خوبی تبلور یافته و پایه های فکری حقوق بشردوستانه اسلام در نظر و عمل متعالی و کارآمد است و مصادیقی چون:رفتار انسانی با اسرا، آزادی انجام فرائض دینی، آزادی انجام کار(نه الزام آن)، حق بر خوراک، پوشاک، بهداشت و اسکان مناسب که واجد پشتوانه ایمانی و اعتقادی می-باشد و در آن انگیزه های الهی و اخروی نهفته است به وضوح موید وضعیت حاکم بر اسرای جنگی در آن دوران است.در پژوهش حاضر با توجه به محتوای آن از روش تحقیق توصیفی- تحلیلی استفاده شده است.The Law Of prisoners of War in The Approach Of The Holy Prophet; From Opinion To Action in Light Of Principles Humanitarian Law in Islam
Islam is religion of peace and amity and not only is not indifferent against topics related to war, goals, fundamentals and principles, but also by having historical backgrounds belongs to 14 centuries ago from performance of Prophet Mohammad and Saint Imams, it is possible to find out that according to specific time and location of those ages, they were progressive in this field and based on effective executive guarantee for observing law of war prisoners in practice (not just theoretical). In history of Islam there are abundant approaches that describe humanitarian behavior of Prophet Mohammad against prisoners of war; The main question of this research is that "What was status of law of prisoners of war during Prophet Mohammad"? The response to this question is that religious teachings of Islam in the field of observing law of prisoners of war in theoretical point of view and approach of Prophet Mohammad was clearly described and ideological fundamentals of humanitarian law in theory and practice were obvious in approach of Prophet Mohammad and instances including: Humanitarian behavior with prisoners of war, freedom of performing religious ceremonies, freedom of work (not obligation), right of food, health, clothes and suitable residence had faith and religious background with divine and afterlife motivations that clearly reveals the status of prisoners of war during that time. In the present research it is benefit from descriptive- analytical research methodology.
