نظارت سیاسی بر حقوق افراد دارای معلولیت در ایران و ارائه الگوی مطلوب

چکیده
بیشک، قوانین ومقرراتی که درهرجامعه وضع میگردند زمانی مؤثر ومفید خواهند بودکه دارای ضمانت اجرا بوده ونتیجه عدم اجرای آن نیز مشخص گردد و ثانیا به جهت کارآمدی و اجرای دقیقتر وکاملتر آن، سازوکار لازم برای نظارت برآنها نیز مشخص شود. حقوق معلولان نیز به عنوان یکی از مهمترین شاخه های حقوق بشری در نظام داخلی و بین المللی محسوب شده و به عنوان حقوق قشر قابل توجه و البته آسیب پذیر جامعه، باید به طور دقیق و کامل اجرا گردد که مستلزم پیشبینی واتخاذ سازوکار مناسب جهت نظارت بر اجرای آن میباشد. نظارت سیاسی که توسط قوه مقننه بر قوه مجریه انجام میشود، یکی از مهمترین نظارتهایی است که بر قوه مجریه صورت گرفته و از طریق ابزارهای مختلفی انجام شده وبا توجه به اینکه اجرای حقوق معلولان نیز به عهده قوه مجریه میباشد تبعا این نظارت، باید راجع به این قوه در خصوص میزان اجرای حقوق این افراد نیز انجام شود. به دنبال بررسی نقایص موجود در نظارت سیاسی بر حقوق معلولان در ایران، پژوهشها نشان داد در نظم حقوقی کنونی، هم به دلیل جایگاه نهاد متولی امور معلولان و هم به دلیل عدم امکان سنجی مناسب وتخصصی درمجلس شورای اسلامی، این نوع نظارت، به طور مؤثر و دقیق، صورت نمیگیرد. رویکرد این نوشته در نظارت سیاسی بر حقوق معلولان، اتخاذ سیاست افتراقی دراین زمینه میباشد. دراین نوشته، پس ازبررسی نقش کنونی نظارت سیاسی برحقوق معلولان درایران، راهکارهای مطلوب سازی این نظارت از جمله، ایجاد کمیسیون تخصصی در مجلس به این منظور، تغییر جایگاه سازمان متولی امور معلولان، امکان سنجی حضور رئیس سازمان متولی امور معلولان در هیئت وزیران وهمچنین انجام تغییرات در ساختار کمیسیون اصل نود قانون اساسی به عنوان الگوی مطلوب، مورد بررسی قرار گرفته است.political supervision on rights of people with disabilities in Iran and providing the desired pattern

The political supervision that is carried out by the legislative branch on the executive branch is done through various means, and it should be done according to this branch regarding the implementation of the rights of the disabled. Following the examination and explanation of the shortcomings in the political Supervision of the rights of the disabled in Iran, the researches showed that in the current legal system, both due to the position of the body in charge of the affairs of the disabled and the lack of appropriate and specialized evaluation in the Islamic Council, this The type of Supervision is not done effectively and accurately. The approach of this article in the political Supervision of the rights of the disabled is to adopt a differential policy in this field.
