واکاوی کتاب «ثلاث رسائل فی الجهاد»، روش شناسی اجتهاد - نواندیشی های فقاهتی

چکیده
«روش شناسی اجتهاد»، شناسایی توصیفی یا تحلیلی مراحلِ منضبطِ فرایند استنباط حکم شرعی و «روش اجتهاد»، شیوه ای است که در آن، فقیه براساس مبانی پذیرفته شده، استدلالی را سامان می دهد و بر پایه آن استنباط می کند. روش تجمیع ظنون (روش تحلیلی) و روش صناعت محور (روش تطبیقی) دو روش محوری در روش های اجتهاد است که مکتب فقهی قم از روش اول و مکتب فقهی نجف از روش دوّم بهره برده و هر روش، دارای مختصات، آثار مترتّب بر روش و گام های تولید فتوا است. با بررسی روش اجتهادی دو مکتب فقهی قم و نجف و مقایسه آن با مختصات روش اجتهادی این کتاب، این نتیجه به دست آمده است که روش اجتهادی این کتاب، روشی « تحلیلی - تاریخی - واقعی» است که می توان آن را، روش اجتهادی جامع نگر یا جامعیّت محور نامید که جامع بین فقه سنتی (اصالت) و فقه نوین (معاصرت) می باشد. به نظر می رسد روش شناسی اجتهاد این کتاب می تواند مقدّمه ای بر کشف مکتب فقهی مؤلّف ژرف اندیش و جامع نگر آن باشد. نواندیشی های فقاهتی این کتاب که بیشتر در باب «امان» یافت می شود، شامل نواندیشی های محتوایی، ساختاری و محصول جدید علمی است.An Analysis of “Three Articles on Jahad”; A Book by Ayatollah Khamenei- Ijtihad Methodology, Fiqh-Based Neo-Intellectualism
Developing an Ijtihad-based methodology is to identify descriptive or analytic stages related to the process of inferring a religious decree; and developing an Ijtihad-based method is to explore ways based on which Fuqahas support an argument and infer, using recognized and available principles. Both the analytic and comparative methods are among Ijtihad-based methods. Qom’s Fiqhi (jurisprudential) school of thought employs the first one while Najaf’s Fiqhi school of thought employs the second. Each method has the parameters and steps to issue a Fatwa. By studying the Ijtihad-based method of the two schools of thoughts in Qom and Najaf and by comparing it with the Ijtihad-based method of this book (Three Articles on Jahad), this conclusion is drawn that the book’s method is “analytic-historical-realist” which can be called a comprehensive method between traditional and modern Fiqh. It seems that the Ijtihad-based methodology of the book can be a prelude to its author’s Fiqhi school of thought. Fiqh-based neo-intellectualism mainly addresses the concept of “Aman”(literally mean mercy, refuge) in Fiqh and includes structural, content, and scientific neo-intellectualism.
