اساسنامه دیوان بین المللی کیفری به قربانیانی که منافع شخصی آنها از رهگذر وقوع جرایم در صلاحیت دیوان، آسیب دیده، تحت شرایطی اجازه مشارکت در جریان دادرسی را می دهد. این بیان کلی، در مقررات قواعد دادرسی و ادلّه دیوان و نیز رویه قضایی این مرجع، دقیق تر تبیین شده و چگونگی مداخله بزه دیدگان در فرایند دادرسی کیفری نزد دیوان مشخص شده است. تمرکز بر حقوق بزه دیدگان و مسایل راجع به آنان در دیوان بین المللی کیفری بسیار فراتر از دادگاه های یوگسلاوی و رواندا است. رویکرد به حقوق بزه دیدگان در مراجع کیفری بین المللی و بین المللی شده ای که بعد از دیوان بین المللی کیفری تأسیس شده اند نیز بیشتر شده است. در مجموع دو نگاه درخصوص مقررات اساسنامه دیوان در باب مشارکت بزه دیدگان مطرح است؛ دیدگاه اول نگاهی مثبت به این موضوع دارد؛ اما نگرش دوم، این مشارکت را واجد آثار سوء بر دادرسی کیفری بین المللی تلقی می کند.متن
Guaranteeing the Victim's Right to Be Present in the Proceedings of the International Criminal Court
he Statute of the International Criminal Court allows the victims whose personal interests have been damaged by the occurrence of crimes under the jurisdiction of the Court, under certain conditions, to participate in the proceedings. This issue has been explained more precisely in the provisions of the court's rules of procedure and evidence, as well as the judicial procedure of this authority. Also, the intervention of the victims in the criminal proceedings before the court has been specified. The focus on the rights of the victims and issues related to them in the International Criminal Court is much more than in the courts of Yugoslavia and Rwanda. Attention to the rights of victims has increased in international and internationalized criminal authorities that were established after the International Criminal Court. In total, there are two approaches regarding the provisions of the Court's statute regarding the participation of the victims; The first point of view has a positive view of this issue, but the second point of view considers this participation as having bad effects on international criminal proceedings.
