چکیده
امروزه ایده خودروی خودران به واقعیت تبدیل و این نوع خودرو وارد صنعت حمل ونقل شده است. در ایران تردد خودروهای خودران به دلیل فقدان قوانین مربوط و مشخص نبودن مسئول در تصادفات احتمالی، ممنوع اعلام شده است؛ بنابراین پژوهش حاضر، با رویکرد توصیفی-تحلیلی درصدد بررسی این امر است که در صورت ورود خودروهای خودران به ایران، آیا قوانین کیفری فعلی، جوابگوی مسائل ناشی از صدمات ایجادشده توسط خودرو خودران است. این پژوهش، صرف نظر از سایر عوامل، تنها به مسئولیت تولیدکننده پرداخته و به این نتیجه رسیده است که با توجه به مقررات فعلی و محدودیت علم امروز دنیا در حوزه هوش مصنوعی، امکان تعقیب شرکت خودروساز در مواردی که صدمه ایجادشده توسط خودروی خودران ناشی از عدم تکافوی علم روز در پیش بینی شرایط حادثه ساز بوده و تولیدکننده تمام آزمایش های معمول را انجام داده است، میسر نبوده، اما در اغلب موارد امکان تعقیب و محکومیت با توجه به قوانین فعلی نیز وجود دارد و از این منظر قواعد و قوانین کنونی پاسخگوی مسئله مسئولیت مرتبط با خودروی خودران است.Criminal Liability of Factory and Programme designer of autonomous Car in respect of their Injuries to humans
Nowadays, development of technology results in the production of autonomous cars. With no doubt, Iran will face the presence of these cars in near coming years. In June 2017, the first autonomous car was tested successfully in Iran, but the chief constable prevented using them because of lack of specific regulation and no clear Statute to the identification of the criminal liability for their injuries to humans. Therefore, this Paper will scrutinize if the current Iranian criminal law has the potentials of imposing criminal liability for the injuries. This research limited the discussion to the Factory and Program designer and analyses the subject by the descriptive-analytical approach. It finally concludes that because of limitation of nowadays science and current regulations, in some limited circumstances, conviction of factories and designers is not possible, however, in most cases, it is possible to prosecute and convict the factory and designer and Iran is not faced with lack of regulation in this respect
