چکیده
بررسی و نقد ساختار،شیوه رسیدگی و صلاحیت هیأت حل اختلاف قانون«نحوه صدوراسناد مالکیت املاکی که اسناد ثبتی آنها در اثرجنگ یا حوادث غیرمترقبه ای مانند:زلزله ،سیل و آتش سوزی از بین رفته اند.» ازمنظر دادرسی اداری بخصوص ازدیدگاه تحقق دادرسی منصفانه موضوعی است که در این پژوهش بدان پرداخته شده است.ایده اصلی پژوهش آن است که این هیأت،دارای صلاحیتهای ترافعی وتشخیصی بوده و درواقع علاوه بر اینکه یک دادگاه اختصاصی اداریِ ثبتی است درعین حال به عنوان یک مرجع اداری نیز برخی صلاحیتهای تشخیصی دارد.با استفاده ازروش توصیفی- تحلیلی با رویکرد کیفی و متکی بر مطالعات کتابخانه ای در این تحقیق ضمن معرفی و شناسایی ماهیت حقوقی و کارکرداین هیأت به آسیب شناسی آن به منظوراصلاح ساختار،صلاحیت و نظارت قضایی بر این مرجع پرداخته و سازوکارهایی نیز ارائه شده است. همچنین در خصوص ضرورت یا عدم ضرورت وجود و استمرار فعالیت این هیأت درساختارمراجع ثبتی کشور سخن گفته که نتیجه این بررسی ها حاکی از ضرورت استمرار فعالیت این هیأت البته با اصلاحاتی استCritique and analysis of nature and role the registration dispute resolution board law"How to issue property ownership documents whose documents have been destroyed due to war and emergencies such as earthquakes, floods and fires."

Using a descriptive-analytical method with a qualitative and dependent approach Library studies in this study, while answering the main question about the nature of The registration dispute resolution board, its pathology in order to improve the structure and competence of this reference and mechanisms have been presented. He also spoke about the necessity or non-necessity of the existence and continuation of the activities of this board in the structure of the country's registration authorities, and the results of these studies indicate the necessity of the continuation of the activities of this board, of course, with amendments
