چکیده
بحث وصیت و وصایت و مسایل پیرامون آن از دیرباز موضوع تحقیق و بررسی دانشمندان حقوق و فقهای اسلام بوده است. آنچه این موضوع را نزد ایشان مهم جلوه داده است، شاید این بوده باشد که انسان غیر معتقد به اصول مذهب و ایدئولوژی دینی، به واسطه این که با فوت خویش، خود را فانی می-داند و طومار حیات خود را در هم پیچیده می بیند، چندان توجهی به اوضاع پس از مرگ خود ندارد و برای وی مهم نیست که بعد از او اموالش چگونه خواهد شد و به چه مصارفی خواهد رسید. اما در جامعه ای که انسان ها معتقد به عقیده ای مذهبی و مؤمن به معاد پس از مرگ هستند، نقش زندگی پس از مرگ در نظر آنان مهم تر و خطیرتر از زندگی قبل از مرگ است. لذا افراد معتقد به زندگی اخروی در صدد اصلاح و اداره امور خویش پس از مرگ می باشند؛ زیرا خود را حتی پس از مرگ نیز مسؤول و متعهد در مقابل دستورات مذهبی که از جانب خداوند به صورت وحی بر پیامبران نازل شده می دانند. در این پژوهش، جایگاه وصیت در جوامع پیشین و سپس در مذاهب اسلامی و و اهمیت آن به صورت تطبیقی مورد مداقه و مطالعه قرار گرفته است.Comparison of the conditions of the testator from the perspective of the seven Islamic schools of thought
