چکیده
در بازنگری قانون اساسی در سال 1368، اختیارات لازم به ریس جمهور و هیات وزیران برای حل و فصل اختلاف بین دستگاههای اجرائی پیش بینی شد. دولت برمبنای اصل مذکور، اقدام به وضع مقررات و پیش بینی سازوکار حل اختلاف در درون قوه مجریه نمود که مهمترین آنها آئین نامه چگونگی رفع اختلاف بین دستگاههای اجرایی مصوب 1386 می باشد. قریب 14 سال از اجرای آیین نامه مذکور می گذرد و تجربه اجرای آن به خوبی می تواند نمایانگر ظرفیتها و چالشهای نظام حقوقی ایران در حل اختلافات دستگاههای اجرایی بر مینای اصل 134 ق.ا باشد. همین مساله ضرورت انجام پژوهشی با روشی توصیفی-تحلیلی و ابزار تحلیل محتوا را مبتنی بر این سوال که رابطه نظام حقوقی حاکم بر حل و فصل اختلافات بین دستگاههای اجرائی با اصل 134 ق.ا چیست ایجاب نمود. یافته های پژوهش بیانگر آن است که رفع چالشهای نظام کنونی حل و فصل اختلافات نیازمند درج حکمی دائمی در قانون در راستای تمرکز حل اختلافات برمبنای آئین نامه چگونگی رفع اختلاف و منع دستگاههای اجرایی از طرح دعاوی علیه یکدیگر در مراجع قضایی می باشد.Proportionality of the legal-executive system Resolving disputes between executive bodies and the constitution
In the 1989 revision of the constitution, the necessary powers were provided to the president and the cabinet to resolve disputes between the executive bodies. Based on the mentioned principle, the government took action to regulate and anticipate the dispute resolution mechanism within the executive branch, the most important of which is the by-law on how to resolve disputes between executive bodies approved in 2007. Nearly 14 years have passed since the implementation of the mentioned by-law and the experience of its implementation can well reflect the capacities and challenges of the Iranian legal system in resolving the disputes of the executive bodies based on Article 134 of the ICCPR. The findings of the study indicate that resolving the challenges of the current dispute resolution system requires the inclusion of a permanent provision in the law in order to focus dispute resolution based on the bylaws on how to resolve disputes and prevent executive bodies from filing lawsuits against each other in the judiciary.
