چکیده
شریعت اسلام چون سایر ادیان الهی به زمان و مردمی خاص محدود نیست و نیز به جهت جهان شمولی اش در طول زمان دستخوش تغییر و تبدیل نمی شود، زیرا «حلال محمد حلال الی یوم القیامه و حرامه حرام الی یوم القیامه». از سوی دیگر، در مسیر تفکر و اندیشه بشری مسائلی نو قرار می گیرد که فقه اسلامی باید پاسخگوی آن باشد و به حل آن همت گمارد. یکی از مشکلات جوامع انسانی وجود افرادی است که به عللی برخی از اندام های خود را از دست داده و یا دچار از کارافتادگی شده اند. این افراد برای ادامه زندگی خود نیاز دارند تا با عمل جراحی، آن عضو فاسد را به عضوی سالم تبدیل کنند. این موضوع که برداشت عضو از بدن هر فرد و پیوند آن به دیگری از لحاظ شرعی چه حکمی دارد و فقها و مذاهب اسلامی چه برخوردی با این قضیه کرده اند، ارزش والای علمی دارد و کاوش درباره ی آن برای ادامه ی پیشرفت و ترویج این روش درمانی در درجه نخست اهمیت قرار دارد. بررسی ضرورت اهدای عضو و نقش حیاتی آن در معالجه بیماران و جایگاه آن در اندیشه دینی محورهای اصلی بحث استدلالی این پژوهش می باشند. مفاهیم و کلیات پیوند اعضا، بررسی فقهی پیوند اعضا و اهدا و برداشت از منظر مذاهب اسلامی از مباحث مطرح در این پژوهش می باشند.Organ donation, its necessity and place in religious thought
Islamic law, like other divine religions, is not limited to a specific time and people, nor does it change over time due to its universality, because "Muhammad is lawful until the Day of Resurrection and forbidden is forbidden until the Day of Resurrection." On the other hand, new issues are placed in the path of human thought that Islamic jurisprudence must answer and strive to solve. One of the problems of human societies is the existence of people who have lost some of their organs or become disabled. These people need to continue their lives to have surgery to turn that rotten limb into a healthy one. The issue of what is the ruling on the removal of an organ from the body of each person and its connection to another from a religious point of view, and how Islamic jurists and religions have dealt with this issue, has great scientific value and research on it to continue progress and promote this method. Treatment is paramount. The study of the necessity of organ donation and its vital role in the treatment of patients and its place in religious thought are the main axes of the argumentative discussion of this research. Concepts and generalities of organ transplantation, jurisprudential study of organ transplantation and donation and perception from the perspective of Islamic religions are among the topics discussed in this study.
