بررسی شمولیت نفقه با رویکرد فعالیت های هنری زوجه

چکیده
در «فقه اسلامی» موارد مختلفی وجود دارد که در زندگی انسان ها نقش به سزایی دارد. یکی از آن موارد مبحث «نفقه» است. نفقه به سلسله حقوقی گفته می شود که تحت شرایط و نظم خاصی به زن تعلق می گیرد. مقاله حاضر به بیان مواردی از هزینه های زن (نفقه) می پردازد که آیا برخی فعالیت های هنری، ورزشی و غیر آن برای زن می تواند جزو نفقه محسوب شود یا خیر؟ زیرا توجه به روحیه حساس و لطیف زن و توانایی او درخلق اثرهای هنری می طلبد تا در این راستا استعدادهای او شکوفا شود و از پرتو آن استحکام و آرامش خانواده بیشتر و از این رهگذر نیز، باعث افزایش درآمد اقتصادی برای خانواده باشد. بدون شک رویکرد فقهی به این مسئله می تواند موضوع نفقه را وارد عرصه دیگری از زندگی زناشویی و استحکام آن در پرتو نفقه نماید. از این رو در این مقاله به روش تحلیلی و توصیفی با رویکرد کتابخانه ای با مراجعه به منابع و متون فقهی موارد نفقه بررسی شده و به این نتایج دست یافته که موارد احصا شده برای نفقه انحصاری نبوده و با توجه به نیاز و شرایط زمان و مکان قابل توسعه می باشد. رویکرد تحقیقی این مقاله به روش کتابخانه ای به مواردی می پردازد که به موضوع اختصاص مالی به عنوان نفقه برای آموزش و هزینه های لازم در امور هنری تا فارغ التحصیلی که لازم است، برای آن انجام بشود و البته بعد از رسیدن به مرحله استادی یا کارآفرینی می تواند به اقتصاد خانواده کمک کند.Investigating the inclusion of alimony with the approach of wife's artistic activities
In "Islamic jurisprudence" there are various cases that play an important role in human life. One of those cases is the issue of "alimony". Alimony is a legal series that is given to a woman under certain conditions and rules. This article discusses some of the costs of women (alimony) whether some artistic, sports and other activities for women can be considered as alimony or not? Because it requires attention to the sensitive and delicate spirit of women and their ability to create works of art in order to develop their talents in this regard, and in the light of that, more strength and peace of the family and through this, increase economic income for the family. Undoubtedly, the jurisprudential approach to this issue can bring the issue of alimony into another area of adultery and its strength in the light of alimony. Therefore, in this article, by analytical and descriptive method with a library approach, by referring to the sources and jurisprudential texts, alimony cases have been studied and it has been concluded that the counted cases for alimony are not exclusive and according to the needs and conditions of time and place. Is expandable. The research approach of this article deals with the case of the library method, which deals with the issue of allocating money as alimony for education and necessary expenses in artistic affairs until the graduation that is required for it, and of course after reaching the stage of mastery or entrepreneurship. It can help the family economy.
