چکیده
با توجه به آن که زندان در حال حاضر به مجازات اصلی و فراگیر تبدیل شده و نزد برخی حقوقدانان از بهترین و مهم ترین مجازات ها به شمار می آید و از سویی زندانی، انسان بوده و دارای کرامت نفس است و با حبس، تنها آزادی تن او سلب شده و دیگر حقوق شهروندی او محفوظ می ماند. حقوق معنوی زندانیان از منظر اسناد داخلی و بین المللی موضوع این پژوهش به صورت توصیفی- تحلیلی می باشد. از آن جا که زندانی در دوره محکومیت در زندان از دیگر حقوق شهروندی برخوردار می باشد و تنها آزادی تن او سلب شده و به علت تجاوز به آزادی و حقوق دیگران و عدم رعایت حد و حدود قانونی آن ها گرفتار مجازات حبس گردیده است اما همین شخص زندانی از حقوقی در زندان برخوردار می باشد که مورد تأکید اسناد داخلی و بین المللی قرار گرفته است. حقوق زندانیان به دو نوع مادی و معنوی تقسیم شده که جلوه های حقوق معنوی زندانیان نظیر حق تکریم، حق ارتباط با خویشان، حق سلامت و... از جمله مظاهر آن می باشد.Manifestations of the Moral Rights of Prisoners in Domestic and International Documents
Given that prison has now become the main and comprehensive punishment and is considered by some jurists to be one of the best and most important punishments, and on the one hand, the prisoner is a human being and has dignity, and with imprisonment, only his physical freedom is taken away and his other citizenship rights are preserved. The moral rights of prisoners from the perspective of domestic and international documents are the subject of this research in a descriptive-analytical manner. Since the prisoner enjoys other citizenship rights during the period of his sentence in prison and only his physical freedom is taken away and he is imprisoned due to violating the freedom and rights of others and not respecting their legal limits and boundaries, the same prisoner enjoys rights in prison that have been emphasized by domestic and international documents. The rights of prisoners are divided into two types, material and moral, and the manifestations of the moral rights of prisoners such as the right to respect, the right to communicate with relatives, the right to health, etc. are among its manifestations.
