مسئولیت نقصان یافته در نظام کیفری ایران و انگلستان

چکیده
امروزه نظام های عدالت کیفری با بهره گیری از مفهوم حقوقی مسئولیت نقصان یافته تلاش می کنند دلایل و شیوه های وقوع رفتار مجرمانه توسط افرادی که از نابهنجاری های روانی رنج می برند را تحلیل کنند. این پژوهش به بررسی جایگاه مسئولیت کاهش یافته در حقوق کیفری ایران و تطبیق آن با قوانین کیفری انگلستان پرداخته است. مسئله اصلی پژوهش، نبود پیش بینی صریح مفهوم مسئولیت نقصان یافته در نظام حقوقی ایران و تأکید انحصاری بر مسئولیت کامل یا رفع کامل مسئولیت است. هدف این پژوهش، تحلیل مقایسه ای این موضوع در دو نظام حقوقی ایران و انگلستان با تمرکز بر استخراج نقاط قوت و ضعف قوانین ایران است. یافته های پژوهش نشان می دهند که استفاده مناسب از تجربیات تطبیقی می تواند نقش مهمی در ایجاد عدالت کیفری متناسب تر ایفاء کند.Diminished Liability in the Criminal Systems of Iran and England
Today, criminal justice systems, using the legal concept of diminished responsibility, try to analyze the reasons and methods of criminal behavior by people suffering from mental disorders. This study examines the position of diminished responsibility in Iranian criminal law and its comparison with the criminal laws of England. The main problem of the study is the lack of explicit prediction of the concept of diminished responsibility in the Iranian legal system and the exclusive emphasis on full responsibility or complete removal of responsibility. The purpose of this study is to conduct a comparative analysis of this issue in the two legal systems of Iran and England, focusing on extracting the strengths and weaknesses of Iranian laws. The findings of the study show that the appropriate use of comparative experiences can play an important role in creating more appropriate criminal justice.
