چکیده
تناسب جرم و مجازات یکی از اصول بنیادین حقوق بین الملل کیفری است که بر اجرای عدالت و جلوگیری از بی عدالتی در مجازات تأکید دارد. این اصل بیان می کند که شدت و نوع مجازات باید با ماهیت و شدت جرم همخوانی داشته باشد. در حقوق بین الملل کیفری، دادگاه ها و نهادهای قضایی بین المللی موظفند تا با توجه به عوامل مختلف از جمله شدت جرم، نقش و مشارکت متهم، تاثیرات جرم بر جامعه و قربانیان، و شرایط خاص پرونده، تصمیم گیری کنند. رعایت این اصل نه تنها به حفاظت از حقوق بشر کمک می کند، بلکه به افزایش اعتبار و مشروعیت نظام های قضایی بین المللی نیز می انجامد. در عین حال، چالش های اجرایی و مفهومی مانند تعریف دقیق جرم های بین المللی و تعیین معیارهای مناسب برای مجازات ها، همچنان وجود دارد. این مقاله به بررسی اصول و چالش های موجود در تناسب جرم و مجازات در حقوق بین الملل کیفری پرداخته و نقش آن در تقویت نظام عدالت بین المللی را مورد تحلیل قرار می دهد.Proportionality of crime and punishment in international criminal law
Proportion of crime and punishment is one of the fundamental principles of international criminal law that emphasizes the implementation of justice and prevention of injustice in punishment. This principle states that the severity and type of punishment should match the nature and severity of the crime. In international criminal law, courts and international judicial bodies are required to make decisions according to various factors, including the severity of the crime, the role and participation of the accused, the effects of the crime on society and victims, and the specific circumstances of the case. Compliance with this principle not only helps to protect human rights, but also increases the credibility and legitimacy of international judicial systems. At the same time, operational and conceptual challenges such as the precise definition of international crimes and the determination of appropriate criteria for punishments still exist. This article examines the principles and challenges in the proportionality of crime and punishment in international criminal law and analyzes its role in strengthening the international justice system.
