چکیده
نظم عمومی از مهمترین نهادهای حقوقی است که در نظام حقوقی تمام کشورها جایگاه ویژه ای دارد. نظم عمومی در زمره مفاهیم بنیادین، معمول و در عین حال پرچالش در قلمرو حقوق داخلی و بین المللی است. این مفهوم، علاوه بر نقش محدود کننده در قلمرو داخلی، در قلمرو بین ال مللی، اعمال قوانین و قواعد مخالف نظم عمومی کشور میزبان را با مانع روب رو میسازد. نزدیکی این مفهوم با مفاهیمی همچون اخلاق حسنه ، سبب تداخل مفاهیم و تقابل مسائل مشابه با یکدیگر شده است. با توجه به چنین اهمیتی، سوال نوشتار حاضر این است که رابطه مفاهیم نظم عمومی و اخلاق حسنه در حقوق ایران با ملاحظه بررسی تطبیقی مفاهیم مربوطه در نظامهای حقوقی خارجی و کنوانسیونهای حقوق بشری چیست؟ در پاسخ به این سوال، با استفاده از روش تحقیق: توصیفی تحلیلی، چنین نتیجه گرفته شده است که هر چند به صورت سنتی نظم عمومی با مفهوم اخلاق حسنه پیوند خورده است، با این حال بررسی ها نشان می دهد که نمی توان مفاهیم نظم عمومی و اخلاق حسنه را به یکدیگر تقلیل داد. مناسب ترین نظریه بر اساس موضع قانونگذار در مواد قانونی، انفکاک این دو در مفهوم و ماهیت از یکدیگر و رابطه منطقی عموم و خصوص من وجه در مصادیق آن ها به نظر می رسد. در مواد 14 و 15 اعلامیه حقوق بشر اسلامی (1990 قاهره) توجهی ویژه به نظم عمومی و همچنین مصادیق اخلاق حسنه شده است که بررسی آنها می تواند نتیجه پژوهش را تایید کند.The concept of public order and its relationship with good morals in Iranian law
Public order is one of the most important legal institutions in the legal system of all countries. The importance of the concept of public order in the legislative process makes it inevitable to identify and explain it. Public order on fundamental concepts is common, yet challenging in the domain of domestic and international law. This concept, in addition to its restrictive role in the domestic territory, in the international territory, impedes the application of laws and regulations contrary to the general order of the host country. The closeness of this concept to concepts such as good ethics interferes with concepts and confronts similar issues. Given this importance, the question of the present article is that What is the relationship between concepts: public order and good morals in Iranian law? In answer to this question, using the research method: descriptive-analytical, it has been concluded that though, the public order is traditionally linked to the concept of good morals. However, studies show that The concepts of public order and good morals cannot be reduced to one another. According to the authors, the most appropriate logical relationship that can be established between these two concepts: public-specific relations
