چکیده
اهمیّت بررسی فقهی و حقوقی نحوه اعمال حاکمیّت دولت جمهوری اسلامی ایران بر اراضی موات، به دلیل ماهیّت انفالی و ضرورت اعمال نظارت دولتی نسبت به این اراضی در دوران غیبت است. بر اساس قوانین موضوعه، دولت مالک و دارای اختیار تصرّف مالکانه در رقبه اراضی موات است. این مالکیّت و اختیار تصرّف مالکانه در رقبه اراضی موات، بر اساس مبنای حاکمیّت منصبی ائمه اصول علیهم السلام نسبت به اراضی موات، برنامه ریزی و اعمال شده است. با بررسی و مقایسه دلایل مالکیّت شخصی امام اصل(ع) با دلایل اقامه شده از سوی قائلین مبنای حاکمیّت منصبی امام اصل(ع)، این نتیجه حاصل است که رقبه اراضی موات، متعلّق به ائمه اصول علیهم السلام است. بر این اساس، انتظار می رود در دوران غیبت، با تعدیل اختیار دولت در انتقال رقبه اراضی موات از طریق تصویب قانون جدید، مالکیّت امام اصل(ع) نسبت به رقبه اراضی موات تثبیت و از انتقال مالکیّت رقبه اراضی موات به بهره برداران جلوگیری به عمل آید.A research on the way of applying the government's sovereignty over wastelands

Based on this, it is expected that during his absence, by adjusting the government's authority to transfer the rival lands of favorable land through the approval of the new law, the ownership of Imam Asl (a.s.) over the rival lands of favorable lands will be stabilized and the transfer of the ownership of rival lands of favorable lands to the exploiters will be prevented. Action will come.
