درآمدی بر علل اجرایی نشدن برخی اصول قانون اساسی جمهوری اسلامی ایران

چکیده
عدم اجرای اصول قانون اساسی، اشکالی است که همواره به ارزش و اعتبار این سند بنیادین خدشه وارد می کند. این جستار در پی پاسخ به این پرسش است که علل اجرایی نشدن برخی از اصول قانون اساسی از زمان تصویب آن ها چیست و از چه راه هایی می توان آن ها را اجرایی کرد؟ در قالب پژوهشی توصیفی تحلیلی، عواملی همچون «خلأهای تقنینی در اصول برنامه ای قانون اساسی»، «تاریخی و مبنایی بودن محتوای برخی اصول قانون اساسی»، «اقتضایی بودن اجرای برخی اصول قانون اساسی»، «وجود موانع سیاسی در مسیر اجرای برخی اصول» و «وجود موانع فنی در مسیر اجرای برخی اصول» در زمره مهم ترین موانع اجرایی شدن برخی از اصول قانون اساسی شناخته شده اند؛ ازاین رو، صرف نظر از عدم اجرای برخی از اصول که برخاسته از خصیصه های ذاتی و ماهیتی آن ها هستند، مانند اصول تاریخی و مبنایی و اقتضایی که اساساً نمی توان عدم اجرای این قبیل اصول را اشکال شمرد، اهتمام به تصویب قوانین عادی خواسته شده در ذیل برخی از اصول قانون اساسی، اجتناب از تفاسیر غیرضروری و اصلاح تفاسیر ناصواب، رفع موانع سیاسی اجرای قانون اساسی، استفاده از سازوکارهایی جهت رفع موانع فنی اجرای قانون اساسی یا اصلاح اشکالات فنی موجود در قانون اساسی برای اجرایی شدن اصول مغفول ضروری دانسته شده اند.An Introduction to the Reasons for the Non-Implementation of Certain Principles of the Constitution of the Islamic Republic of Iran
Non-implementation of the principles of the constitution has always been considered as a problem that harms the value and credibility of this fundamental document. This essay sought to answer the question that what the reasons for not implementing some of the principles of the constitution were since their approval, and in what ways they can be implemented. In the form of a descriptive-analytical research, factors such as "Legislative gaps in the programmatic principles of the constitution", "The historical and basic nature of the content of some principles of the Constitution", "The necessity of implementing some principles of the Constitution", "The existence of political obstacles in the way of the implementation of some principles" and "the existence of technical obstacles in the way of the implementation of some principles" were recognized as among the most important obstacles to the implementation of some principles of the Constitution. Therefore, regardless of the non-implementation of some principles that originate from their inherent and essential characteristics, such as historical, fundamental and contingent principles, the non-implementation of such principles cannot be considered as a problem. Paying attention to the approval of normal laws required under some principles of the Constitution, avoiding unnecessary interpretations and correcting incorrect interpretations, removing political obstacles to the implementation of the Constitution, using mechanisms to remove technical obstacles to the implementation of the Constitution or correcting the technical problems in the Constitution for Implementation of the neglected principles was deemed necessary.
