چکیده
جماع و رابطه جنسی عموماً از اسباب و طرق ضرب و جرح و یا قتل دیگری نیست. با این وجود، صعوبت در جماع در یکی از زن و مرد می تواند آسیب های جبران ناپذیری به شریک جنسی او بزند و یا حتی در پاره ایی موارد منجر به مرگ او شود. علم و آگاهی فرد از بیماری خود که او را از برقراری یک رابطه جنسی متعارف محروم ساخته است و نیز آگاهی از این که برقراری رابطه جنسی، اضرار به غیر را به دنبال دارد (قصد نتیجه)، به ویژه با فرض عدم رضایت شریک جنسی، درصورت عدم امکان قصاص و منصوص بودن خسارت در قانون، محکوم به پرداخت دیه می شود و در غیر این صورت، ملزم به پرداخت ارش است، زیرا ادله اباحه استمتاع مطلق نیستند و در مواردی به حرمت نیز، ختم می شوند که به دنبال خود، مسؤولیت کیفری جانی را به دنبال دارد، ولی چنان چه فرد از بیماری خود آگاه نباشد و یا هدفش از برقراری رابطه جنسی، اضرار به غیر نباشد و یا شریک جنسی او راضی باشد، فاقد مسؤولیت کیفری است و محکوم به پرداخت دیه و یا ارش می گردد.Responsibility for Homicide by Sexual Relation in Jurisprudence and Iranian Criminal Law

The knowledge and awareness of the individual about his/her illness that has deprived him/her of having a normal sexual relationship, as well as the awareness that having a sexual relationship will cause harm to others (intention of the result), especially assuming that the sexual partner does not consent, if retribution is not possible and the damage is stipulated in the law, he is sentenced to pay blood money, and otherwise, he/she is obliged to pay Arsh, because the evidence of permissibility of enjoyment is not absolute and in some cases, they also end up in Haraam, which entails criminal liability. However, if the individual is not aware of his illness or his/her purpose in having a sexual relationship is not to harm others or his/her sexual partner is satisfied, he/she lacks criminal liability and is sentenced to pay blood money or Arsh.
