ساختار حقوق تامین اجتماعی در نظام حقوق داخلی و حقوق بین الملل

چکیده
گفته شده که انسان موجودی اجتماعی و مدنی الطبع است و ساختار حیات بشری اقتضاء می کند او در اجتماع زندگی کند و با زندگی با دیگران به تکامل و توسعه دست یابد. اما در عمل گاهی اوقات مشکلات زندگی به قدری بر پیکره انسان ها می تازد و سنگینی می کند که نیازمند کمک و مساعدت دولتها و حمایت سازمان هایی است که متصدی و متولی خدمات عمومی هستند که با حمایت آنها بسیاری از این مشکلات برطرف خواهد شد. در عین حال اهمیت حقوق تامین اجتماعی به اندازه ای است که در قوانین اساسی بسیاری از کشورها به این نوع حقوق و امتیازات به صراحت تاکید شده و اسناد بین المللی نیز از آنها غافل نمانده است. به طور معمول بیماری، بیکاری، اخراج از محل کار، از کارافتادگی، فوت و بازنشستگی در اثر کهولت سن می توانند زندگی هر انسانی را مختل سازند و او را دچار استیصال و فقر جانکاه نمایند. اهمیت حقوق تامین اجتماعی به قدری زیاد است که جزء موازین بنیادین و اساسی حقوق بشر قلمداد شده و در اعلامیه جهانی حقوق بشر 1948 و میثاق بین المللی حقوق مدنی و سیاسی 1966 مصوب مجمع عمومی سازمان ملل متحد هم مورد تاکید قرار گرفته و از آن حمایت جدی بعمل آمده است. نتایج تحقیق ثابت می کند که هر دو نظام حقوق داخلی و حقوق بین الملل توجه ویژه ای به موضوع حقوق تامین اجتماعی داشته و تامین ملزومات آنها از مهمترین دغدغه های دولتها و سازمان های بین المللی است که تلاش دارند با لحاظ گزارشات سالانه توسعه انسانی از رعایت منظم و قانونمند حقوق تامین اجتماعی در همه کشورها اطمینان حاصل کنند.Structure of Social Security Rights in the Domestic and International law System
It has been said that man is a social and civil-natured creature and the structure of human life lead him to live in a community and attains to evolution and development by living with others, but sometimes, the problems of life are so heavy on the human shoulder that it needs the help and assistance of governments and the support of organizations that are in charge of public services and many of these problems will be solved by their support. At the same time, the importance of social security rights is so much that these types of rights and privileges are explicitly emphasized in the constitutional laws of many countries, and international documents have not neglected them. Usually, illness, unemployment, extrusion, disability, death and retirement due to old age can disrupt every human being life and cause to desperation and poverty. The importance of social security rights is so great and is considered as part of fundamental and basic standards of human rights and is emphasized and supported in the Universal Declaration of Human Rights in 1948 and the International Covenant on Civil and Political Rights in 1966 approved by the United Nations General Assembly, and the research results approved that both domestic and international law systems have paid special attention to the issue of social security rights, and the provision of their necessities is one of the most important concerns of governments and international organizations that are trying to assure from regular and lawful observance of social security rights in all countries by considering the annual reports of human development.
