چکیده
معمولاً حقوق بین الملل را حقوق واقعی نمی دانند. این گفته نادرست است ولی بر حقایق غیر قابل انکار حقوق بین الملل تکیه دارد که بدرستی درک نشده اند: حقوق بین الملل قوه مقننه، قضاییه و مجریه متمرکز و اثر بخشی ندارد؛ حقوق بین الملل بیش از آنکه بنفع دولت های ضعیف باشد بنفع دولت های قوی است و غالباً نقض می شود بدون اینکه نقض آن مجازاتی بدنبال داشته باشد. دانش حقوق بین الملل ترکیبی از نظریه پردازی و آرمان گرایی است. بی توجهی به ویژگی های خاص حقوق بین الملل باعث غفلت از طرز کار عملی حقوق بین الملل شده است. حقوقدانان و اساتید معمولاً حقوق بین الملل را در بستر آموزه های حقوق داخلی شرح و توضیح دهند و این باعث شده تا سوالات زیادی در این رشته بی پاسخ باقی ماند. به وجود آمدن و تغییر حقوق بین الملل چگونه است؟ رفتار کشورهای کاملاً متفاوت چگونه تحت تاثیر آن قرار می گیرد؟ کی و چرا کشور ها آنرا رعایت می کنند؟ نوشتار حاضر یک تحلیلی بنیادین در جهت توضیح رئالیستی طرز کار عملی حقوق بین الملل است. با در نظر گرفتن واقعیت های روابط بین الملل با استفاده از ابزاری بنام تئوری انتخاب منطقی به این سوال ها پاسخ مناسب خواهیم داد.Analysis of International Law in the Light of Rational Choice Theory
International law is not usually considered to be real law. This statement is incorrect, but it relies on undeniable facts of international law that are not properly understood: international law does not have a centralized and effective legislative, judicial, or executive branch; international law benefits strong states more than it benefits weak states, and it is often violated without punishment for its violation.The knowledge of international law is a combination of theorizing and idealism. Ignoring the specific features of international law has led to neglect of the practical workings of international law. Lawyers and professors usually explain and explain international law in the context of domestic legal doctrines, and this has left many questions in this field unanswered. How does international law come into being and change? How is the behavior of completely different states affected by it? When and why do states observe it? This article is a fundamental analysis aimed at explaining the practical workings of international law in a realistic way. Taking into account the realities of international relations, we will provide appropriate answers to these questions using a tool called rational choice theory.
