چکیده
هدف از این پژوهش نشان دادن ایرادات رویکرد حاکم بر مقابله با جرم اقتصادی است. این پژوهش به روش توصیفی-تحلیلی درصدد پاسخگویی به این پرسش است که چه رویکردی باید برای مبارزه با جرائم اقتصادی در پیش گرفت؟یافته ها نشان می دهند که رویکرد امنیتی حاکم بر مبارزه با این جرائم از طریق جرم انگاری موسع و مبهم و پیش بینی سازوکارهای سختگیرانه موجب شده است که بازگرداندن اموال ناشی از جرم و اشخاص مرتکب به کشور دچار مشکل شود. همچنین در مواردی هیجان زدگی در نوع برخورد با مرتکبان دیده می شود؛ به گونه ای که جرم اقتصادی در هیأت جرمی امنیتی شناسایی می شود.به منظور مبارزه شایسته با این جرائم و اتخاذ رویکردی مناسب نسبت به آن لازم است به نقش دولت به عنوان یکی از عوامل ارتکاب جرم، تیپ شناسی مرتکبان جرم اقتصادی و آثار گسترده ای که بر جای می گذارد، توجه داشت. ازاین رو پیشنهاد می شود که رویکرد حاکم بر مبارزه با این جرائم از رویکرد امنیتی به رویکردی تخصصی تبدیل شود و بر این اساس، یک سیاست کیفری افتراقی مبتنی بر تخصص تعبیه شود که کنشگران آن در مراحل مختلف تحقیق، تعقیب و دادرسی از تخصص لازم برخوردار باشند.A Critique of the Prevailing Approach for Combating Economic Crimes; Passing the Security Approach
The purpose of this research is to show the defect in the prevailing approach for combating economic crime. This research with descriptive-analytical method seeking to answer the question of what approach should be taken to combat economic crimes?The findings show that the prevailing security approach to combat these crimes through broad and vague criminalization and the strict provisions has caused that it will be difficult extradition and return of assets. Also, in some cases, combating is emotional. So that economic crime is identified as crime against security.In order to fight these crimes perfectly and adopt a suitable approach towards, it is necessary to pay attention to the role of the government as one of the factors of crime, the typology of economic crime perpetrators and the widespread effects they leave behind. Therefore, it is suggested that the governing approach to fight against these crimes be changed from a security approach to a specialized approach. And therefore, a differential criminal policy based on expertise should be implemented that its actors have the necessary expertise in different stages of investigation, prosecution and trial.
