مسؤولیت کیفری هوش مصنوعی در حقوق کیفری ایران با نگاهی به قوانین اتحادیه اروپا

چکیده
با گسترش استفاده از رایانه و اینترنت در زندگی روزمره، جرایم مرتبط با فضای مجازی نیز افزایش یافته اند. این امر نشان دهنده اهمیت تطبیق قوانین و مقررات حقوقی با تکنولوژی و واقعیت های جدید است. همین امر ممکن است باعث چالش های حقوقی شود. بر همین اساس هدف مقاله حاضر برسی این سؤال است که رویکرد حقوق کیفری ایران و اتحادیه اروپا نسبت به مسؤولیت کیفری هوش مصنوعی چگونه است؟ این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانه ای به بررسی موضوع مورد اشاره پرداخته است. یافته ها بر این امر دلالت دارد که در حقوق اتحادیه اروپا برای هوش مصنوعی مسؤولیت کیفری قائل نشده و لازمه مسؤولیت کیفری هوش مصنوعی این است که به آن شخصیت حقوقی اعصاء شود. در حقوق کیفری ایران نیز برای هوش مصنوعی مسؤولیت کیفری تعریف نشده است. عدم امکان نیل به اهداف مجازات، غیرقابل اجرابودن مجازات های بدنی و سالب آزادی و مجازات های مالی مهم ترین چالش های قائل شدن مسؤولیت کیفری هوش مصنوعی است.Criminal Responsibility of Artificial Intelligence in Iranian Criminal Law with a View to European Union Laws
With the expansion of the use of computers and the Internet in everyday life, crimes related to cyber space have also increased. This shows the importance of adapting legal rules and regulations to new technologies and realities. This may cause legal challenges. Accordingly, the purpose of this article is to examine the question of what is the approach of the criminal law of Iran and the European Union to the criminal liability of artificial intelligence? This article is descriptive and analytical and it has investigated the mentioned subject by using the library method. The findings indicate that there is no criminal liability for artificial intelligence in European Union law and the requirement for criminal liability of artificial intelligence is that it has a legal personality. Criminal liability is not defined for artificial intelligence in Iran's criminal law. The impossibility of achieving the goals of punishment, the unenforceability of corporal and deprivation of liberty punishments and financial punishments are the most important challenges of assigning criminal responsibility to artificial intelligence.
