مبانی حقوقی تاسیس مدارس غیردولتی در ایران با تاکید بر نقش آموزش و پرورش بر پیشگیری از وقوع جرم

چکیده
پایه و اساس هر جامعه ای با تعلیم و تربیت افراد آن جامعه ارتباط مستقیم و شکل گیری شخصیت نسل جدید به عوامل مختلف درونی و بیرونی بستگی دارد. عوامل دخیل در تربیت متعدد و در عین حال دارای درجه خاصی از تاثیر می باشند. در میان این عوامل مختلف بیشترین تاثیر در تربیت به خانواده و مدرسه برمی گردد. تحصیل و آموزش رایگان و برخوداری از آن از حق های بشری و مصرح در قانون اساسی است. مدارس غیردولتی با مجوز مجلس شورای اسلامی تاسیس شدند. این مدارس مغایرتی با اصل تحصیل رایگان نداشته و با اصل حق آزادی و انتخاب آموزش و کسب علم اندوزی در اسلام، مشارکت در امور جامعه در مغایرت نمی باشند. مدرسه و نظام آموزشی می تواند نقش موثری در پیشگیری از وقوع جرم داشته باشد و در سال های اخیر، سند تحول نظام آموزشی، دفتر پیشگیری از آسیب های اجتماعی، طرح پیشگیری و درمان اعتیاد معتادان، سند تحول فضای مجازی و مشارکت دادن خانواده در امور مدرسه از جمله اقداماتی است که صورت گرفته است.The Legal Basis of Establishing Non-governmental Schools in Iran, Emphasizing the Role of Education in Preventing Crime

These schools do not conflict with the principle of free education and do not conflict with the principle of the right to freedom and choice of education and acquiring knowledge in Islam and participation in community affairs.
