ارث زوجه از اموال غیرمنقول با تأکید بر فتوای آیت الله العظمی خامنه ای (مدظله العالی)

چکیده
پیرامون ارث زوجه از اموال غیرمنقول میان فقهاء اختلافاتی وجود دارد. لکن بین فقهای امامیه به جز ابن جنید- اتفاق بر محرومیت از برخی «ما ترک» غیرمنقول زوج وجود دارد. در این میان نظریه سید مرتضی قابل توجه است و می توان آن را منشأ تغییر قانون براساس فتوای آیت الله خامنه ای در این زمینه تلقی کرد. لکن در تبیین این قول لازم است که به ادله اقوال دیگر و اشکالات ناظر بر این نظر پرداخت؛ چراکه تبیین سید مرتضی پیرامون نظریه اش محتاج بسط و تفصیل است. در مقاله حاضر در مقام تبیین این فتوا برآمده ایم و پس از نقد دلیل قول به محرومیت زوجه از بخشی از ترکه زوج حتی از قیمت آن، مستندات فتوای سید مرتضی و برخی فقیهان معاصر ازجمله آیت الله خامنه ای- که قائل به عدم محرومیت زوجه هم از عین و هم از قیمتِ بخشی از ترکه زوج می باشد- بررسی شده و شواهدی در تأیید آن بیان شده است. با این تبیین، مستند تغییر قانون مدنی مربوطه نیز مطابق فتوای آیت الله خامنه ای روشن شده است.Wife's Inheritance from Immovable Property with Emphasis on Ayatollah Khamenei's Fatwa
There are disagreements among Faqihs (Islamic experts) about wife’s inheritance from the immovable bequest. All Imamia Faqihs- except for Ibn al-Junayd- unanimously agree over the wife’s deprivation of her husband’s certain immovable properties. A theory developed by Sayyid Murtadha is here noteworthy which could be regarded as the source of change of law in this regard based on Ayatollah Khamenei’s Fatwa. However, one should address all arguments and faults dealing with this issue as Sayyid Murtadha’s explanations regarding his theory need more details and clarity. This article seeks to explain this Fatwa. After criticizing the reason for the opinion that the wife is deprived of part of the husband's bequest, even from its price, the evidence for the fatwa of Sayyid Murtadha and some contemporary jurists, including Ayatollah Khamenei, who believe that the wife is not deprived of both the bequest and its price, has been examined, and evidence has been presented to substantiate it. With this explanation, the evidence for the relevant change in the Civil Code is also clarified as per the fatwa of Ayatollah Khamenei.
