چکیده
مطلوب پروردگار برای آدمی، آبادانی زمین و بهره برداری از خیرات و برکات آن است. طلب عمران زمین از جانب مولابه بندگان صادر شده است که دال بر مطلوبیت آبادانی نزد مولا و وجوب کفایی آن است. به نظر می رسد که این آبادانی، با استقرار در زمین و برنامه ریزی برای سکونت در آن شکل می گیرد. اما سؤال این است: حکم اولی آبادانی و ساخت وساز مسکن چیست؟ چه دلایلی بر آن قائم است؟ کاربری مسکونی به دلیل آیات کریمه در برخی شرایط وجوب و در برخی شرایط احکام تکلیفی دیگری را بر می تابد. از مجموع روایات مانند احیای موات، بنای حائط، کاروانسرا و... نیز حکم اولی ساخت وساز، جواز برداشت می شود، اما به دلیل سیره عقلا و قواعد فقهیه حفظ نظام، لاضرر، عمران و تأمین رفاه، ساختن مسکن در حد کفایت و مطلوب واجب است. برای به دست آوردن یافته های پژوهش که با رویکرد توصیفی، تحلیلی حاصل شده است ازمنابع و قواعدفقهی و نیز سیره عقلا بهره جسته شده است.Land development rules for housing construction
It is God's will for man to cultivate the earth and enjoy its goodness and blessings.The request for the development of the land has been issued by Molabeh Bandaneh, which indicates the desirability of development with Molabeh and the necessity of its sufficiency.It seems that this settlement is formed by settling on the land and planning to live in it.But the question is what is the first sentence of housing development?Residential use due to the verses of the Crimea in some circumstances is obligatory and in some circumstances is subject to other mandatory provisions.From the totality of narrations such as reviving the dead, building a fortress, caravanserai, etc., the first sentence of construction is permitted.However, due to the morals and rules of jurisprudence: maintaining the system, harmlessness, development and providing welfare, building housing is sufficient and desirable.In order to obtain the research findings that have been obtained with a descriptive-analytical approach, sources and jurisprudential rules as well as the manners of the wise have been used.
