چکیده
هنگام رسیدگی به موضوعات مختلف در دادرسی اداری، وقایع زیادی رخ می دهد؛ احکام و دستورهایی صادر و به دنبال آن یک سری عملیات اجرایی صورت می گیرد. این عملیات در حین دادرسی، پس از ختم دادرسی و در نتیجه اجرای حکم یا تصمیم انجام می گیرد. عملیاتی که در این حین به صورت کامل یا ناقص اجرا می شود، گاهی به اعاده نیاز دارد. این بازگشت می تواند به جهات مختلف، ازجمله اشتباه های ساده یا اساسی باشد و در بعضی موارد با مشکلاتی همراه است که در اینجا باید به دنبال جایگزین هایی برای آن بود. در این حین امکان ورود ضرر و زیان نیز وجود دارد و اشخاصی نیز مسئول آن می باشند. نوع آرا و تصمیمات اتخاذ شده در دادرسی اداری به جهت آنکه این اعمال حقوقی یک جانبه هستند، به گونه ای است که آن را با حقوق خصوصی یا جزا متمایز می کند از یک سو با دولت طرف هستیم و از سوی دیگر با حقوق اشخاص. این تمایز و ویژگی سبب خواهد شد اعاده عملیات اجرایی در دادرسی اداری با دقت ویژه ای صورت گیرد. نتیجاً لازم به ذکر است که شیوه سنتی اعاده عملیات اجرایی، لازم به تغییر است و شیوه قدیم با توجه به نظم عمومی حاکم در بعضی موارد پاسخگوی مشکلات جامعه نخواهد بود.Examining the restoration of executive operations in administrative law

The type of votes and decisions taken in administrative proceedings, because these legal acts are unilateral, is such that it is distinguished from private or penal rights, on the one hand, we are on the side of the government, and on the other hand, with the rights of individuals. This distinction and feature will cause the restoration of executive operations in administrative proceedings to be done with special care. As a result, it is necessary to mention that the traditional way of restoring executive operations needs to be changed and the old way will not be the answer to the society's problems in some cases due to the prevailing public order.
