مشروعیت ملی دولت ها در رویه اتحادیه های منطقه ای

چکیده
این پژوهش در جهت بررسی مشروعیت و روند تحول مفهوم مشروعیت دولت از مسیر رویه اتحادیه های منطقه ای انجام گرفته است. از آنجایی که بارزترین مولفه مشروعیت رعایت و احترام حقوق بشر است. بر این مبنا دولت بر پایه حقوق و نظم و امنیتی که برای مردم و از سوی مردم برقرار می کند،ارزیابی می شود. لذا امروزه دولت های برپا شده از راه های غیر قانونی نظیر کودتاها، تجاوزها، برقراری تبعیض های نژادی با بحران مشروعیت نزد افکار عمومی مواجه هستند.به خصوص انکه با تشکیل اتحادیه های منطقه ای مولفه های مشروعیت ملی دولتها تحول یافته است.در راستای انجام پژوهش این سوال مطرح میشود که: مولفه های مشروعیت ملی دولت در رویه اتحادیه های منطقه ای چگونه تحول یافته و چه تاثیری در حقوق بین الملل نوین داشته است . برای پاسخگویی به سوال روش پژوهش تطبیقی-توصیفی و به صورت کتابخانه ای است.نتایج حاصله از این پژوهش نشان می دهد: تنها کنترل موثر یک دولت،اساس مشروعیت ملی تلقی نمی شود بلکه روش ها و ابزارهای دموکراتیک در رسیدن به قدرت و نیز توانایی حکومت های ملی در برقراری ثبات در جامعه براساس احترام به حقوق بشر وآزادی های اساسی شهروندان در رویه اتحادیه های منطقه ای مورد شناسایی قرار گرفته است.The National legitimacy of governments in the regional unions procedures
This research has been done to investigate the legitimacy and evolution process of the concept of government legitimacy by regional unions. Since the most obvious component of legitimacy is respect for human rights, on this basis, the government is evaluated based on the rights, discipline and security that it establishes for the people and by the people. So, nowadays the governments stablished based on illegal ways like coups, aggressions and ethnic and racial discrimination are facing the crisis of legitimacy to public opinion. Especially by formation of regional unions, the components of national legitimacy of governments have evolved.In order to carry out the research, the following question is raised: how have the components of national legitimacy of the government evolved in the procedure of regional unions and what impact has it had on modern international law? To answer this question the research method is comparative-descriptive and library-based. The result shows that not only the effective control of a government is not considered the basis of national legitimacy, but also democratic methods and tools in reaching power as well as the ability of national governments to establish stability in society based on respect for human rights and basic freedoms of citizens in the procedure of regional unions has been identified
