پیشگیری از جرائم سبز در پرتو رویکردهای جرم شناسی انتقادی

چکیده
تاریخ دریافت: 08/03/1402 تاریخ بازنگری: 21/05/1402 تاریخ پذیرش: 19/06/1402جرائم علیه محیط زیست به اقداماتی اطلاق می شود که تحت شرایطی خاص، به آلودگی یا از بین رفتن و یا آسیب به مظاهر محیط زیست، منتج است. اهمیت پیشگیری از این جرائم از این جهت است که با سلامتی انسان ها به صورت مستقیم ارتباط دارد. علاوه بر موارد مذکور، باید اضافه کرد که با جهانی شدن فرآیندهای اقتصادی و فرهنگی، بحران ناشی از آسیب های زیست محیطی در سطحی فراگیرتر منعکس گشته است که در این راستا جرم شناسی سبز، ابتداء، با نوعی نگاه بدبینانه نسبت به این نوع موضوعات و پیشگیری از جرائم زیست محیطی شروع به کار کرد و مهمترین خصیصه ی جرم شناسی سبز، انتقادی بودن آن است. از آنجا که محیط زیست، ارزش و مصلحتی حقوقی است که در دهه های اخیر، مورد توجه واقع شده است، لذا پیشگیری از جرائم مرتبط با آن نیز حائز اهمیت است. اغلب کشورها، رژیم جزائی خاصّی در این مورد به اجرا می گذارند؛ بدین جهت، این مهم، موضوعی ویژه در شکل دهی سیاست جنایی قانونی در مورد حفاظت از محیط زیست است که قابل مطالعه و بررسی است. هر انسان اندیشمندی با درک این تهدیدات، پی می برد که راه حل، فقط، به پیشگیری از ادامه تخریب و حفاظت از محیط زیست، منحصر است؛ از این رو، پژوهش حاضر بر این است به بررسی جرم شناسی سبز و تأثیر آموزه های آن در حقوق کیفری ایران و موضع حقوق کیفری ایران در پیشگیری از جرائم زیست محیطی بپردازد.Prevention of Green Crimes with Approaches of Critical Criminology
Crimes against environment are applied to measures that under specific conditions, resulted in pollution, destruction or damage to epitomes of environment. The importance of prevention of these crimes is because of that, there is direct relationship with healthy of human beings. Furthermore, should be added that with globalization of economic and cultural processes, the crisis of environmental damages is reflected in more pervasive level that in this approach, at first, the green criminology started to work with a kind of pessimistic view about this kind of subjects and prevention of environmental crimes and being critical is the most important factor of green criminology. Since environment is noticed as a value and legal expediency, in recent decades, so prevention of related crimes with them is so important. Most countries performed special criminal system in this matter; so this important subject in forming legislative criminal policy about protection from environment is possible to study and survey. Each wise person with comprehension of these threats, will understands that the solution is exclusive to prevention from continue of destruction and protection of environment; furthermore, in this research, will try to survey green criminology and effect of its findings in criminal law of Iran in prevention of environmental crimes.
