چکیده
با رشد اشخاص حقوقی، بحث امکان ارتکاب جرم از سوی آنها و مسئولیت آنها در قبال انجام جرم در میان حقوق دانان دنیا شکل گرفت. بدیهی است با توجه به ماهیت متفاوت اشخاص حقوقی نسبت به اشخاص حقیقی، مجازات های قابل اعمال بر این اشخاص هم باید در مواردی متفاوت از اشخاص حقیقی باشد. ماده ی ۲۰ قانون مجازات اسلامی حقوق ایران، به تعیین مجازات های قابل اعمال بر اشخاص حقوقی اختصاص یافته است. نوظهوربودن مسئولیّت کیفری اشخاص حقوقی در نظام کیفری ایران - به عنوان یک اصل- و مسبوق به سابقه بودن این موضوع در نظام کیفری فرانسه، فرصت مغتنمی را برای مطالعه تطبیقی این دو نظام فراروی این تحقیق که به روش توصیفی – تحلیلی صورت گرفته است، نهاد. نظامهای کیفری فرانسه و ایران با درک این واقعیت، ضمانت اجراهای بایستهایی چون جریمه، ممنوعیت از فعالیّت شغلی و حرفهایی، ممنوعیت از افزایش سرمایه، ممنوعیت از صدور سندهای تجاری و انتشار حکم محکومیت برای این منظور در نظر گرفته اند.Conditions and scope of criminal liability of public law entities in the legal systems of Iran and France
With the growth of legal entities, the debate over the possibility of committing a crime by them and their responsibility for committing a crime arose among jurists around the world. Obviously, due to the different nature of legal entities from natural persons, the penalties applicable to these persons should also be in different cases from natural persons. Article 20 of the Islamic Penal Code of Iran is dedicated to determining the penalties applicable to legal entities. The emergence of criminal responsibility of legal entities in the Iranian penal system - as a principle - and the precedent of this issue in the French penal system, provided a great opportunity for a comparative study of these two systems before this descriptive-analytical study. . Realizing this fact, the French and Iranian criminal regimes have provided guarantees for the implementation of mandatory measures such as fines, prohibition of professional and professional activities, prohibition of capital increase, prohibition of issuing commercial documents and issuance of convictions for this purpose.
