چکیده
بررسی مسائل جهادی اسلام در توسّل به نیروی نظامی و اقدامات قهرآمیز علیه دشمن و نحوه رفتار با غیر نظامیان و افراد غیر مقاتل، حاکی از ابتنای مقرّرات بشر دوستانه اسلام بر اصول بنیادینی است که در وضعیّت های مختلف مخاصمات، زمینه های لازم را برای اجرای احکام جهادی اسلام فراهم می سازند. عدالت، حقّ حیات و احترام به کرامت انسانی از جمله مبانی حقوق بشردوستانه اسلام محسوب می شوند که هر کدام از آنها جایگاه و اهمیّت خاصی در جهاد فی سبیل الله دارند. ادلّه قرآنی، روایی، عقل، اجماع و قواعد مسلّم فقهی، تولید و کاربرد تسلیحات کشتار جمعی را منع کرده است؛ لذا در این نوشتار ضمن بررسی مفهوم و مصادیق تسلیحات کشتارجمعی، مباحثی چون عدالت، حقّ حیات و کرامت انسانی که به عنوان مبانی عدم جواز استفاده از تسلیحات کشتارجمعی بحث شده، به بررسی آیات و روایات، عقل و اجماع که از جمله مهم ترین ادلّه صدور حکم در خصوص مباحثی نظیر تسلیحات کشتار جمعی است؛ پرداخته می شود. در این تحقیق، منع تولید و بکارگیری تسلیحات کشتارجمعی در فقه اسلامی مورد واکاوی قرار گرفته و مصادیق سابق آن را می توان تنقیح مناط و وحدت ملاک گرفته و بر مصادیق فعلی منطبق کرد؛ همچنین منع بکارگیری این سلاح ها در شرایط عادی از قواعد عرفی مستفاد می گردد.Jurisprudential analysis of the production and use of weapons of mass destruction

Quranic evidence, narration, reason, consensus and Muslim jurisprudence rules have prohibited the production and use of weapons of mass destruction; Therefore, in this article, while examining the concept and examples of weapons of mass destruction, topics such as justice, the right to life, human dignity, which are discussed as the bases for not allowing the use of weapons of mass destruction, to examine the verses and traditions, reason and consensus, which are among the most important evidences for issuing verdicts. Regarding topics such as weapons of mass destruction; Paid. In this research, the prohibition of the production and use of weapons of mass destruction in Islamic jurisprudence has been analyzed, and in the books of the jurists of the previous examples, it can be revised and applied to the current examples; Also, the prohibition of using these weapons in normal conditions is based on customary rules.
